Description
W52H09-10-C-0006 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION CMO #09-555 1. Contracting Agency: U.S. Army TACOM Contracting Center, Rock Island, IL 61299 7630. 2. Description of Action: This action will result in a Firm Fixed Price contract with General Dynamics Armament and Technical Products, Inc. (GDATP). Award is projected for the fourth (4th) quarter of FY09. This procurement will be funded by Army Working Capital Fund (AWCF) sources. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan. 3. Description of Supplies/Services: The Government's current requirement is for fifteen (15) each GAU-19 Machine Guns without Barrels, NSN: 1005-01-560-2160, P/N: 10055418. The estimated value is $ 1,250,000.00. The proposed contract will include a 100% option at an estimated dollar value of $ 1,500,000.00. This will result in a total quantity of 30 each at a total estimated dollar value of $ 2,750,000.00. 4. Authority Cited: 10 USC 2304(c)(1), only one Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements as implemented by FAR 6.302 1. 5. Reason for Authority Cited: As authorized by FAR 6.302 1, procurement by other than full and open competition is necessary because a competitive Technical Data Package (TDP) is not available. GDATP is the original designer and manufacturer of the GAU-19 0.50 Caliber Machine Gun and is the only firm holding the design, development and software for this requirement. GDATP owns the proprietary rights to the TDP, and it is unlikely that the Government will acquire the TDP for future procurements. The time and cost to reverse engineer the gun and its components is estimated at four (4) years and $5.5 Million, which is also the estimate for a performance specification to be written. Funds and time are not currently available for this effort, and in addition the design would have to go through Product Verification Testing and Air Worthiness Testing. Development and testing costs would not be recouped through competition since these costs would be amortized over a very small quantity. In addition, any qualified alternate source would require an additional two years of Production Lead Time after qualification to initiate product deliveries based upon a competitive procurement. 6. Efforts to Obtain Competition: Although this procurement will be restricted to the aforementioned contractor, every effort will be made to alert potential subcontractors. This requirement was synopsized in the Government-wide Point of Entry (GPE) through FedBizopps.gov IAW FAR 5.201(d)(1) to further increase subcontracting opportunities and any proposal received shall be considered. 7. Actions to Increase Competition: Technical design, development, data, and software knowledge are not available. As stated, the 0.50 Caliber Machine Gun is a proprietary system developed and patented by GDATP. Competition will not increase because the Program Manager has determined it would take four years of engineering effort at a cost of $5.5 Million to acquire a competitive TDP. Furthermore, funds are not available to reverse engineer or to prepare a performance specification for this item. 8. Market Research: Market Research conducted in September 2009 by the TACOM Gatling Gun Weapon System Manager, AMSTA-LC-WSA, resulted in the findings that GDATP is the only firm with the design, development, and technical knowledge necessary to successfully produce the 12.7mm (0.50-Caliber) Gatling gun for successful integration onto the broad range of platforms required by the Government. The Gatling gun is a proprietary system developed and patented by GDATP. No other sources exist within the worldwide market place to acquire this weapon without a long drawn out reverse engineering effort which has been determined not cost effective. 9. Interested Sources: To date, no other sources have expressed an interest in writing. The notices required by FAR 5.201 have been published, and any proposals received shall be considered. 10.
