- W52H0909D0139 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Agency: Army Contracting Command/TACOM Contracting Center Rock Island, IL 61299 7630. 2. Description of Action: This action will result in a Firm Fixed Price, three year Indefinite Delivery Indefinite Quantity (IDIQ) contract with Cadillac Gage/HR Textron. Award is projected for the 2nd quarter of FY 09 and FY 09 and Army Working Capital Funds (AWCF) will be used. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan. 3. Description of Supplies/Services: The requirement is for 250 each Circuit Card Assembly, NSN: 5998-01-455-7667, P/N: 44522 to support the M1/M1A1 Abrams series vehicles. Total estimated dollar value of this item for the proposed three year IDIQ is $2,511,254.00. 4. Authority Cited: 10 USC 2304(c) (1), Only one responsible source and no other supplies will satisfy agency requirements as authorized by FAR 6.302 1. 5. Reason for Authority Cited: As authorized by FAR 6.302 1, procurement by other than full and open competition is necessary because Cadillac Gage/HR Textron is the sole source manufacturer of the aforementioned item. Cadillac Gage/HR Textron is the prime contractor, designer and developer of the item. The Government does not presently own adequate technical data or performance specifications necessary to support competitive purchasing. There are also no qualification procedures available per AMSRD-AAR-AIS-TD. They further reported that to develop qualification procedures and a competitive technical data package would cost approximately $3,500,000.00 and take approximately 156 weeks. The actual Engineering analysis includes the cost for any additional test equipment or fixtures, higher level assemblies and or end item system. Plus any costs for test facilities as applicable is estimated to cost $7,500,000.00. This analysis is estimated to take an additional 156 days to accomplish. These costs are not anticipated to be recovered by the Government. Due to the fact that the technical data is unavailable, the estimates given in the AQPSE form are quite high. In order to accurately assure the physical portion of a redesign, it was estimated that an Abrams tank would need to shoot 100 rounds. The rounds are worth about $2,000.00 each. This requirement would be necessary to simulate the life cycle that this circuit card would need to survive. Additionally some of these firings would need to be conducted at high and low temperature extremes while in the GTD assembly. With the above estimated need of testing and engineering, and the scheduling issues with multiple organizations and test sites a redesign would at best be lengthy and it is highly likely that the first designs would fail either physically, or after nuclear hardness testing. Any delay is unacceptable, therefore based on the above information sole source procurement from Cadillac Gage/HR Textron is the only method of procurement available to insure the Government receives this critical technology item by the required delivery date of 28 Apr 2009. The initial Procurement Work Directive (PWD) was issued on 15 Oct 2008 and the Customers Required Delivery Dates (CRDD), is 28 Apr 2009. Since there is no competitive TDP for this item, Cadillac Gage/HR Textron is the only contractor capable of meeting the RDD. 6. Efforts to Obtain Competition: This requirement will be synopsized to further increase both contracting and sub-contracting opportunities IAW FAR 5.201 (c). 7. Actions to Increase Competition: There are is no competitive TDP, nor are there qualification procedures available and the cost to develop the TDP and qualification procedures to include engineering analysis, test equipment, fixtures, end item systems and test facilities is well over six million dollars. Because of this estimate, and because it is not anticipated that the Government would be able to recover the costs required to produce competitive technical data, further attempts to increase competition does not make sense at this time. 8. Market Research: Market Research was performed by AMSRD-AAR-AIS-CML ARDEC engineer on 6 Nov 2008. Based on an inadequate technical data package and his expertise and knowledge of the circuit card assembly, the assigned engineer made a technical evaluation/determination. There is no commercial equivalent to satisfy this requirement. No commercial item will satisfy the Army's need without qualification testing. Developing new competitive sources for the current requirements would not be cost effective. In addition it would unnecessarily delay delivery of these items within the required timeframe. 9. Interested Sources: To date, no other sources have expressed an interest in writing. The notices required by FAR 5.201 will be published and any proposals received shall be considered. 10.
