- W52H0909C0130 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Agency: U.S. Army TACOM Contracting Center, Rock Island, IL 61299 7630. 2. Description of Action: This action will result in a firm fixed price contract with either General Manufacturing, Connectec Company, or McNally Industries. Award is projected for the (4th Qtr FY 2009) and FY 2009 Army Working Capital Funds (AWCF) will be used. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan. 3. Description of Supplies/Services: 300 each Collar Shock Absorbers, NSN 1010-01-063-7680, PN 11579637. The estimated value is $420,000. The proposed contract will not include an option provision. 4. Authority Cited: 10 USC 2304(c)(2), (FAR Title) as implemented by FAR 6.302 2, Unusual and Compelling Urgency. 5. Reason for Authority Cited: Procurement by other than full and open competition is necessary because the items are urgently required in support of Operation Iraqi Freedom (OIF) and Operation and Enduring Freedom (OEF). Although the Government owns a competitive technical data package (TDP), the normal lead time for the Collar Shock Absorber is XXX days after contract award. A total of 300 Collar Shock Absorbers are needed at the earliest possible date to sustain 60MM Mortars in use in OIF and OEF. There are currently XXX backorders for the Collar Shock Absorber and an average monthly demand (AMD) of XXX. Non-availability of the Collar Shock Absorber makes a mortar non-mission capable (NMC) and degrades the operational readiness of units engaged in combat, increasing the risk to soldier survivability. The urgent nature of the buy for the 300 Collar Shock Absorbers - a critical component of the Mortar Mount - is based on the following factors: 1.(OPSEC) 2.The introduction of new lightweight mortar components to replace current 60MM mortar components has been delayed well beyond original expectations due to the need to incorporate engineering changes based on test results. This delay has caused a shortfall of mortar components since initial requirements for legacy spare parts were based on the assumption that the replacement bipod and spares would be available in 2nd QTR FY 09. Current projections are that the replacement will not be ready until 2nd QTR FY 10. General Manufacturing, Connectec Co., and McNally Industries are the only recent suppliers of the 60MM Mortar Mount. It was produced by General Manufacturing as part of the M177 Mortar Mount under Contract W52H09-06-C-0030. It was produced by Connectec Co. under contracts W52H09-05-C-0199 and W52H09-07-P-0493. It was produced by McNally Industries under contract W52H09-07-C-0144. All of the aforementioned contracts were awarded as the result of competitive solicitations. Because of the ability to have a first article test waived and/or because each of these sources has the tooling and experience to make this item each will be able to deliver the product significantly sooner than any other producer. Estimated delivery will be on or before (OPSEC). A new competitive RFP which will result in a four year firm fixed price indefinite delivery, indefinite quantity (IDIQ) contract is currently in process and is expected to be issued shortly with award anticipated in November 2009. If awarded to a contractor requiring a first article, deliveries will not begin until 390 days after award of the contract (estimated to be December 2010). 6. Efforts to Obtain Competition: Competition for this procurement action is not being pursued due to the urgent need for the items. 7. Actions to Increase Competition: A competitive RFP which will result in a four year firm fixed price indefinite delivery indefinite quantity (IDIQ) contract is currently in process and is expected to be issued within one or two weeks. 8. Market Research: There is a competitive TDP in place defining the exact, form, fit and function of the parts. The parts are unique military items used only on the 60MM Mortar which has no commercial equivalent. The components of the assemblies are also defined by TDP to assure form, fit, and function and are also procured competitively. A review of product literature made available on line by manufacturers, distributors, and dealers shows no commercial or non-developmental item that will satisfy the Army's requirement for these items. 9. Interested Sources: There will be other sources interested in the competitive acquisition but there are none that could have first article waived and therefore none that can deliver a product before General Manufacturing, Connectec Co., or McNally Industries. 10.
