Description
Upon the basis of the following justification for other than full and open competition, I hereby approve the issuance of the contractual action pursuant to the authority cited herein. 1.Contracting Activity Department of Veterans Affairs Office of Administration Procurement Section (033C1) 810 Vermont Avenue, NW Washington, DC 20420 2.Nature of Action Being Approved: This justification and approval sets forth the facts and requests approval for a Purchase Order, with LV COMM-SEC, 4007 Sanders Lane, Catharpin Virginia 20143 to continue work on the expansion of the Physical Access Control System (PACS). Amount of award is $72,982.21 3.Description of Services: The contractor shall install the PACS System and provide maintenance for the security system at the EES Crystal City Office and Conference Center, Arlington VA 22202. 4.Statutory Authority: The statutory authority for this justification is 41 U.S.C. 253(c)(1), and Federal Acquisition Regulation (FAR) 6.302-1 (a) (2) (ii) (A), "(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for: (ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in- A) Substantial duplication of cost to the Government that is not expected to be recovered through competition 5.. Rationale Supporting Use of Authority Cited Above: The is required to maintain the continuity of the PACS System. The contractor has installed and maintained all aspects of the current PACS System. The contractor is also responsible for the maintenance of the system which is covered by a service/maintenance contract which will cover future service/maintenance of the equipment to be installed. If any other vendor would be selected it would void the warranty from the manufacture as LV COMM-SEC is the only vendor trained and authorized by the manufacture to provide this installation and maintenance in the DC Metro Area.. 6.Efforts to Solicit Potential Sources: This is a follow on contract for services already being provided by LVCOMSEC to VHA. The follow on will ensure system continuity within the PACS System used by VHA. The PO# for the installation that this is a follow on to is 101-J05088 and the maintenance PO establish that service on this equipment will fall under is 101-J05089. 7.Determination of Fair and Reasonable Cost: The labor costs associated with this Order was competitively negotiated by the Contracting Office prior to award of the original contract. This was done using the competitive process. 8.Market Survey: No market was done as this is a follow on contract and in order to fall under the existing VHA maintenance contact we have to use this vendor. 9.Additional Support for Other than Full and Open Competition: LVCOMSEC is performing satisfactorily and no formal complaints or discrepancies have been filed with the Contracting Officer. They are thoroughly familiar with the systems and requirements of the current contract and are the only contractor authorized to work on the system in place. Full competition will not result in cost savings or higher quality service for VA due to the short timeframe provided for a new contract award prior to the expiration of current Task Order agreement. Award to any other source would most likely result in substantial increase of cost. This requirement is time sensitive and must be responded to thoroughly and expeditiously in meeting the Department's needs. 10.Other Interested Sources: Not available as this is the only vendor authorized provide this services without voiding the warranty. 11.Future Competitive Plans: We do not anticipate competing this contract for the next two years due to the unique capabilities of the personnel assigned and the need to maintain consistency for our telecommunications support activities.
