- The Federal Railroad Administration (FRA) intends to negotiate on a sole source basis with Labelmaster Software Company, 400 East Pine Street, Suite 210, Seattle, WA 98122, pursuant to 41 U.S.C.253(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency equirements. Labelmaster Software Company is the only known source that can provide these services. This request is for a computer-based software program entitled REG-Trieve®, which uses a Folio infobase platform that permits users the ability to retrieve and manipulate information to fit their exact needs. This software search engine gives users the ability to perform numerous simple and complex queries; provides hyperlinks in all documents to CFR Parts and Subparts, both in an entire record, and based on queries generated by the user; provides numerous printing options, and includes a DOT history which enables users to hyperlink quickly to any Notices of Proposed Rules or Final Rules issued by FRA. The FRA has not found any other single solution that provides all of the functionalities listed above. The period of performance will be a base year plus four 1-year option periods. The NAICS Code/Size is 511210/$25M. Specific Requirements The CD-ROM data must be transferable to the hard drives of personal computers, and there must be an option for FRA to transfer the data onto a server network for access to computers connected to the network. The contractor must automatically update the program quarterly, based on information published in the Federal Register as Notices of Proposed Rulemakings (NPRM) or Final Rules. FRA will provide updated internal policy data from time-to-time, and the contractor must include those updates in their quarterly editions as well. All content particular to FRA (both regulatory and internal) must link from a table of contents format designed by FRA. The contractor must automatically build program hyperlinks to any CFR part, subpart, or section whenever the legal section sign (§) is found in any text. For example, if one CFR section references another CFR section and the section sign appears, the program must provide a hyperlink to that section. The same applies whenever an internal FRA document uses the section sign to reference a CFR part, subpart, or section. The software publisher must be willing and able to include the following information particular to the Federal Railroad Administration, and to update the information on a quarterly basis, based on data received from the COTR for this contract: 1. Six compliance manuals (General, Hazardous Materials, Motive Power & Equipment, Operating Practices, Signal & Train Control, and Track). These manuals currently total somewhat over 1,000 pages, and are revised periodically. 2. Technical Bulletins issued by the FRA's Office of Railroad Safety. 3. FRA Notices of Safety Bulletins, Safety Directives, and Safety Advisories. 4. The FRA Guide for Preparing Accident/Incident Reports, which currently totals about 250 pages and is revised periodically. FRA's safety requirements interact with those Congress and of other regulatory agencies, and therefore the program must include the following, which must be automatically updated quarterly without interaction with the COTR for this contract, other than advice from the COTR regarding changes to the United States Code (U.S.C.). 1. Chapters 51 and 201 to 213 of Title 49 of the United States Code (49 U.S.C.). 2. Any other revisions to Federal Railroad Safety Laws deemed necessary by the Contracting Officer's Technical Representative. 3. Regulations and letters of clarification issued by the Pipeline and Hazardous Materials Safety Administration of the Department of Transportation (PHMSA); 4. Certain Department of Transportation regulations (DOT), specifically 49 CFR Part 40; 5. Regulations issued by the Transportation Security Administration; 6. Title 29 of the Code of Federal Regulations and all associated letters of clarification or interpretation (OSHA); 7. Title 40 of the Code of Federal Regulations (EPA); 8. The entire text published in the Federal Register of Notices of Proposed Rules and Final Rules issued by the Federal Railroad Administration and the Pipeline and Hazardous Materials Safety Administration; and 9. All changes to Titles 29, 40, and 49 of the Code of Federal Regulations as published in the Federal Register. The software search engine used as the platform for this computer based program must have the ability to: 1. Give users the options for the following types of queries: a. Basic Search Queries. b. Advanced Queries using quotation marks, or DOS-based wild cards such as * and ?. c. Query Specific CFR Parts and Subparts. d. Provide a Query History. 2. Provide hyperlinks in all documents to CFR Parts and Subparts, both in an entire record, and based on queries generated by the user. 3. Provide the user the ability to tag specific records, and to: a. Copy and paste into word processor formats. b. Save as generic text, Word, and WordPerfect files. 4. Provide users with the following printing options: a. All Records - Prints the whole view the user is in. b. Tagged Records - Prints the records the user tags. c. Records - Prints only the range of records the user selects. d. Selective Records - Prints the text the user has blocked. 5. Other requirements: a. The software must include a DOT History which enables users to hyperlink quickly to any Notices of Proposed Rules or Final Rules issued by FRA. b. The successful contractor must provide all users with technical support during the Federal work week, and must have a toll free number for this support. c. The contractor must provide in-person training to a small group of people on an annual basis, with the group composition to be decided by the COTR. d. The software must not conflict with other software used by FRA, including the specialized Railroad Safety Inspection Program for Personal Computers (RISPC), which is used by FRA's Office of Safety to record inspection information. If any such conflicts are found, the contractor must work with FRA to resolve the conflicts. In the event any such conflicts occur after the contractor has issued a quarterly release, the contractor must re-issue the software at no additional cost to FRA, once the conflict has been resolved. This notice of intent is not a request for competitive proposals, and there is no solicitation package available. Any responses to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit written detailed technical capabilities, pricing and other information, that demonstrates their ability to meet the FRA's needs, by close of this announcement, otherwise a contract shall be issued to Labelmaster Software Company without further notice.
