- Introduction: Pursuant to FAR Subpart 13.106-1(b)(1), the U.S. Army RDECOM Contracting Center, Natick Contracting Division, on behalf of the Naval Health Research Center (NHRC) in collaboration with the Centers for Disease Control and Prevention (CDC), intends to award a firm fixed price purchase order on a sole source basis to: BioTek Instruments, Inc., Winooski, VT 05404. THIS IS NOT A REQUEST FOR PROPOSALS. No solicitation document is available. 1. Nature and description of the supplies or services required to meet the agency's needs: The services to this equipment (BioTek Precision 2000) must be done by the manufacturer of the instrument who has sole and proprietary rights to make upgrades and perform service to the instrument. Upgrade to the instrument involves computer interface which is prohibited by manufacturer and only possible with correct access codes to the instrument. In addition, parts for instruments are only fabricated by the manufacturer of the instrument and not available from other sources. 2. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights, etc.): The BioTeK Precision 2000 instrument is manufactured under patents which prohibit the replication of analogous parts suitable for repair. The instrument software is protected by proprietary rights and cannot be accessed or modified by anyone but the manufacturer. 3. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: An internet search was performed to determine if any other source could perform work to the BioTek Precision 2000 instrument and no other relevant websites or sources are available. 4. Any other facts supporting the use of other than full and open competition: None 5. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: None 6. Interested parties may identify their interest and capability to respond to this requirement to the U.S. Army RDECOM Contracting Center, Natick Contracting Division via e-mail to: stephen.reffel@us.army.mil no later than 12:00 noon on March 15, 2010.
