Description
Federal Acquisition Regulation (FAR) 52.212-3, Offeror Representations and Certifications - Commercial Items (AUG 2009) that must be completed and submitted with the offer. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Programs for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), and FAR Subpart 37.4, Nonpersonal Health Care Services (10 U.S.C. 2304 and 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a fixed-price commercial item contract in response to Request for Quotation (RFQ) 10-10-017-REL. The solicitation is issued on an unrestricted basis. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38. The associated North American Industry Classification System code is 621112 and the small business size standard is $10.0 million. PRICE SCHEDULE: BASE YEAR: 36 days @ $____________________ per day = $_________________________; OPTION YEAR ONE: 36 days @ $____________________ per day = $_________________________; OPTION YEAR TWO: 36 days @ $____________________ per day = $_________________________; OPTION YEAR THREE: 36 days @ $____________________ per day = $_________________________; OPTION YEAR FOUR: 36 days @ $____________________ per day = $_________________________; GRAND TOTAL: $_________________________. STATEMENT OF WORK: The purpose of this acquisition is to acquire an Adult Psychiatrist to provide services at the Crow Service Unit, PHS Indian Hospital, Crow Agency, Montana. The Contractor shall provide coverage 3 days per month. The clinics will be scheduled on Wednesdays between 10:30 a.m. and 5:30 p.m., and coordinated with the Behavioral Health Supervisor at the Crow Service Unit. The procurement is a nonpersonal health care service contract, as defined in FAR 37.101, under which the Contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical and professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). The Contractor shall indemnify the Government for any liability producing acts or omissions by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. The Contractor is required to ensure that its subcontracts for provisions of health care services contain the requirements of the clause at 52.237-7, including the maintenance of medical liability insurance. The Contractor shall not perform medical services until professional staff membership and the Indian Health Service Governing Body has granted clinical privileges in writing. As a prerequisite to performance under the resultant contract, the Contractor performing these services must be privileged in accordance with Indian Health Service/Billings Area credentialing policy. The contract Psychiatrist must have full admitting privileges at an inpatient psychiatric program and must be designated as the physician of record for admissions in order to provide continuity of care between the inpatient treatment program and the Indian Health Service outpatient Mental Health Program on the Crow Indian Reservation. MAJOR DUTIES: The Contractor will provide adult psychiatric services. The Contractor shall provide diagnostic evaluation and treatment recommendations, medication management, and case consultation to the Mental Health and Medical Staff, and coordination of care within the hospital and clinic and between agencies. The Contractor will provide training when requested or on an as needed basis. The Contractor shall be a licensed physician (M.D. or D.O.) who has completed a fully accredited psychiatric residency. The psychiatrist must be board certified or board eligible in Psychiatry or Neurology. The psychiatrist must possess and maintain a full, unrestricted license as an M.D. or D.O. The psychiatrist must apply for, obtain, and maintain medical staff privileges at the local service unit. The psychiatrist shall be under the technical supervision of the Service Unit Clinical Director. The Service Unit Administrative Supervisors are: (1) Chief Executive Officer; (2) Clinical Director; (3) Chief Medical Officer; and (4) Behavioral Health Department Supervisor. The psychiatrist shall be knowledgeable in all areas that are, as a standard, covered by an accredited psychiatric residency. The psychiatrist shall have sufficient experience to adequately diagnose and treat a full range of psychiatric cases, procedures and surgeries. The psychiatrist shall provide services that include outpatient and inpatient consultation. The Contractor shall perform examination and treatment of authorized Indian Health Service beneficiaries according to the clinic schedule or as required by the Service Unit Clinical Director. The Contractor shall generate and maintain proper medical record information on beneficiaries to whom treatment is provided in accordance with Indian Health Service regulations. The Contractor shall prepare all medical record documentation to meet or exceed the established standards of the Indian Health Service facility to include, but not be limited to, timeliness, legibility, accuracy, content and signature. All medical record information generated in the performance of this contract will remain the property of and subject to the exclusive control of the Indian Health Service. The Contractor shall become familiar with and be guided by Indian Health Service formulary. The Contractor shall follow Indian Health Service procedures when prescribing drugs. The Contractor will be authorized to prescribe pharmaceuticals and shall do so according to the availability of drugs listed in the Indian Health Service formulary. Indian Health Service pharmacy services will provide instructions to the prescribing psychiatrist as to substitutions of generic drugs for prescribed drugs. Drugs not on the formulary must be approved by the Service Unit Pharmacy and Therapeutics Committee. The standards of medical practice and duties of the psychiatrist shall be determined pursuant to the Service Unit by-laws, the regulations of the hospital, applicable provisions of law, other rules and regulations of any and all governmental authorities relating to licensure and regulation of physicians and hospitals and the standards and recommendations of the Joint Commission on Accreditation of Health Care Organizations (JCAHO). The psychiatrist shall be required to participate in a quality improvement program, which is consistent with current JCAHO requirements for ongoing monitoring and evaluation of the quality and appropriateness of care. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. All IHS regulations and policies applicable to these Acts shall be enforced. The Contractor shall comply with all IHS facility infection control and safety procedures, practices, and standards. During the performance of the contract, the Contractor shall provide for the consistent performance of patient care processes according to the standard for: (1) Centers for Medicaid and Medicare, who accredits the Crow Service Unit; and (2) The following standards: Comprehensive Accreditation Manual for Hospitals, Laboratory Standards, and the Ambulatory Care Standards as they represent the scope of services of this contract. PERIOD OF PERFORMANCE: The performance of this contract shall be from May 1, 2010 through April 30, 2011, with four 12-month options. QUALIFICATIONS: (1) Board Certified or Board Eligible; (2) Required specialty training; (3) Required clinical practical experience; and (4) Medical Liability Insurance. GOVERNMENT FURNISHED PROPERTY: The IHS shall provide the Contractor with the following: (1) Office space including a computer, supplies and telephone; (2) when authorized, travel costs and any other transportation expenses, in accordance with the Federal Travel Regulations (41 C.F.R. Chapter 300 through 304); and (3) if necessary, authority to use a General Services Administration (GSA) vehicle, for official purposes only. The Contractor will be required to provide evidence of motor vehicle liability insurance covering bodily injury and property damage to protect the Contractor and the Government against third-party claims arising from the operation of all GSA vehicles used in connection with the contract. The Contractor shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The Contractor shall comply with the requirements of FAR subpart 51.2, 41 CFR 101-39, 41 CFR 102-34, and the operator's packet furnished with each vehicle. The Contractor will be authorized to use all areas of the facility made available to him/her. The Contractor must request clearance in order to access restricted areas of the facility; authorization must be granted and is to be used only for official business activities relating to job performance. The Contractor will be authorized to use administrative and professional support personnel in carrying out their assigned duties and objectives. The Contractor will be allowed to utilize copy machines, facsimile machines, libraries and telephone services but should only be utilized for official business activities relating to job performance. The Contractor shall be given an orientation to the IHS role and the Indian community that is being served. The Crow Service Unit will be responsible for getting the Contractor access and clearance to all computer services necessary to carry out his/her duties. SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation; therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. PROJECT OFFICER: The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Supervisor of the Behavioral Health Department at the Crow Service Unit, PHS Indian Hospital, P.O. Box 9, Crow Agency, Montana 59022. The Contractor agrees to include the following information on each invoice: (1) Contractor's name, address; (2) Contract Number; (3) Invoice number and date; (4) Cost or price; (5) Dates of Service, including the number of days worked; and (6) Remit to address. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI). A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Administrative Officer at the Crow Service Unit. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Psychiatry License = 30 POINTS (Potential contractors must submit a copy of State license with the offer); (2) Medical Liability Insurance = 20 POINTS (Potential contractors must submit evidence of medical liability insurance with the offer); (3) Resume/Curriculum Vitae = 20 POINTS (Resume/CV must include information relating to: (i) Board Certification or Board Eligibility; (ii) Specialty Training; and (iii) Clinical Practical Experience, including past and current experience in the field of Psychiatry); and (4) Past Performance = 30 POINTS. The offeror must demonstrate its record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. The offeror must list at least three contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable. Technical and past performance, when combined, are considered approximately equal. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The following FAR and Health and Human Services Acquisition Regulation (HHSAR) clauses are applicable: 52.204-4, 52.212-4, 52.212-5, 52.215-5, 52.217-8, 52.217-9, 52.223-5, 52.223-6, 52.224-1, 52.224-2, 52.227-14, 52.227-17, 52.229-3, 52.232-18, 52.237-2, 52.237-3, 52.237-7, 52.242-15, 52.242-17, 52.245-1, 352.201-70, 352.202-1, 352.203-70, 352.223-70, 352.224-70, 352.227-70, 352.231-71, 352.237-70, 352.237-71, 352.237-72, 352.239-73, 352.242-71, 352.242-72, 352.242-73, 352.270-2, and 352.270-3. The following FAR clauses cited in 52.212-5 are applicable to the acquisition: 52.203-6 with Alternate I, 52.219-8, 52.219-28, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13 and 52.232-33. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 2:00 p.m., on March 25, 2010. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your Company name and address. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government.
