- This Sources Sought Notice is for market research purposes only and shall not be construed as a Request for Proposal or an obligation on the part of the Commodity Futures Trading Commission (CFTC or the Commission) to acquire services. The Government may or may not issue solicitation documents. The Commission does not intend to award a contract on the basis of this Sources Sought, nor pay for the information provided. No entitlement to payment of direct or indirect costs or charges shall arise as a result of submission of responses to the Sources Sought and the Commission's use of such information. Background: The Commission is responsible for regulating commodity futures and option markets in the United States. The CFTC's mission is to protect market users and the public from fraud, manipulation, and abusive practices related to the sale of commodity and financial futures and options, and to foster open, competitive, and financially sound futures and option markets. The Commission's headquarters is located at 1155 21st Street, NW in Washington, DC. The CFTC also maintains regional offices in New York, NY, Chicago, IL, and Kansas City, MO. The Commission's Office of Information & Technology Services (OITS) has the responsibility for management of an automated litigation support program called eLaw. To fulfill its mission in a more cost effective manner, the CFTC established Project eLaw for the creation of an automated law office that seamlessly integrates technology and work processes to support Commission managers and staff in their investigative, trial, and appellate work. In support of this program, the Commission has need of contractor personnel who can perform the functions of Automated Litigation Support (ALS) Specialists. ALS specialists are located at CFTC headquarters in Washington, DC and at each of the regional offices. Description of Services: ALS specialists perform a variety of activities in support of the CFTC Division of Enforcement attorneys and investigators. They provide technical support in the use of the litigation support software (Concordance, CaseMap, TimeMap, LiveNote, Nexidia, and Sanction) used by CFTC, evaluate data produced to CFTC to ensure that it meets the established production requirements, participate in discussions with producing parties relating to production requirements, and perform an analysis of produced data to ensure it meets established requirements. More specifically, the ALS Specialist performs the following functions: 1. Evaluates production data produced to the CFTC to ensure that it complies with the established Document Production standards. 2. Performs a quality review when data is added to the litigation databases. 3. Creates CaseMap and LiveNote databases as needed. 4. Loads transcripts to LiveNote and links exhibit documents to the corresponding transcripts. 5. Provides technical assistance to the attorneys and investigators when discussing production requirements with producing parties. 6. Assists attorneys and investigators in conducting database searches once the electronic data is loaded into Concordance and other appropriate software. 7. Provides technical assistance and guidance to attorneys and investigators on litigation support related processes and software (i.e., Concordance, CaseMap, LiveNote, Nexidia, Sanction). 8. Assists attorneys and investigators in reviewing data and provides indices of electronic media contents. 9. Prepares for and conducts training sessions in the litigation support software used by CFTC. 10. Assists the attorneys during document review by setting up review sessions in the appropriate litigation software package (Concordance, Nexidia). 11. Assists attorneys and investigators in trial preparation by creating a Sanction database for use during electronic trials. Minimum Position Requirements: The ALS Specialist should have at least 3 years of hands-on experience performing complex searches of Concordance databases, have superior communication skills and ability to work with attorneys and other legal personnel who have limited technical skills, and have legal experience specifically related to electronic discovery and automated litigation support software and processes. Minimum education includes a Bachelor's degree from an accredited college in a related discipline, or in lieu of Bachelor's Degree, two additional years of related professional experience. Requested Information: Responses to this notice should include: (1) company name, address and point of contact, (2) a service capability statement, (3) a description of your ability to provide individuals that meet the qualification requirements in any or all of the CFTC locations (Washington, DC, Chicago, IL, New York, NY and Kansas City, MO), (4) examples of projects where you provided similar services to clients, and (5) if your company has its own GSA Federal Supply Schedule contract that includes these services in its scope, provide a copy of that contract (including labor categories, rates, and terms and conditions). Responses to this notice must be submitted in writing (email or fax) and received not later than March 22, 2010.
