Description
JUSTIFICATION AND APPROVAL OTHER THAN FULL AND OPEN COMPETITION Maintenance of Selenia Mammography equipment (1) CONTRACTING ORGANIZATION: Department of Veterans Affairs Southern Arizona VA Health Care System (SAVAHCS) (678/9-90C) Tucson, AZ 85723. (2) DESCRIPTION OF ACTION: This justification for other than full and open competition comes as a result of a current, on going requirement at the SAVAHCS and PVAHCS to establish a contract for annual maintenance service of the Selenia Mammography equipment. (3) DESCRIPTION OF SERVICE: (1) Provide annual maintenance for Selenia Mammography equipment for the Facility Management Service Care Line throughout SAVAHCS. The contractor is to provide all labor, travel and parts to provide all services as required during the normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. (4) AUTHORITY: The Statutory Authority permitting the above action is 41 U.S.C. 253 (c)(1), and the Federal Acquisition Regulation Part 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. (5) APPLICABILITY OF AUTHORITY: Hologic, Inc is the manufacturer of the Selenia Mammography equipment and produces the system to provide mammography results for patients of the Veterans Administration Health Care Systems. There are no distributors that can provide the maintenance and all equipment information is considered proprietary and confidential. The system requires recurring maintenance to ensure they have update capabilities for the current demand of the hospital. Services for maintenance of government owned systems are not available through FSS or any other contractor. (6) EFFORTS TO OBTAIN COMPETITION: Currently, the above-proposed sole source manufacturer is the only firm that can satisfy the Governments requirement as supported by the lack of responses from the special notice announcements on FBO.gov. The manufacturer has confirmed they do not outsource the maintenance to other contractors. Accordingly, all avenues to seek additional competition have been exhausted mandating the purchase directly from Hologic, Inc for all services pertaining to the Selenia Mammography equipment. (7) FAIR AND REASONABLE COST: The maintenance service prices for this service have been provided by the contractor at the commercial market costs with a discount provided to the Veterans Administration. The units are currently the property of individual medical centers and will require ongoing maintenance service and support for the foreseeable future. (8) MARKET SURVEY: It has been found through market research that Hologic, Inc is the only provider with the capability needed for this requirement due to Veterans Administrations ownership of the property. The SAVAHCS Contracting Office will make attempts in the future to search for additional sources and ensure any new requirements are researched thoroughly prior to award. (9) SUPPORTING INFORMATION: Hologic, Inc is currently registered in Central Contractors Registration and does not show up on the Excluded Parties List. (10) OTHER SOURCES: Hologic, Inc is the single firm available to meet the needs for the requested service. (11) STEPS TO FOSTER COMPETITION: The goal of the SAVAHCS is to provide the most efficient and affordable patient care throughout Southern Arizona. The current equipment purchased from Hologic, Inc is proven to be the only one manufacturer that can provide maintenance to proprietary equipment. Accordingly, there are no existing plans by the medical centers to remove the current equipment from inventory and replace with new.
