Description
This synopsis is being posted to the Federal Business Opportunities (FBO) website located at http://www.fbo.gov, the Navy Electronic Commerce on Line (NECO) website located at https://www.neco.navy.mil/, and the Naval Surface Warfare Center, Crane Division, Acquisition website located at http://www.crane.navy.mil/acquisition/synopcom.htm. FBO is the primary point of entry to be used when access to synopses and solicitations from the World Wide Web is required. However, the NECO webpage as well as the Naval Surface Warfare Center, Crane Division, Acquisition webpage serve as alternatives if the FBO website is unavailable.The Naval Surface Warfare Center, Crane Division intends to enter into a Basic Ordering Agreement (BOA) with Aeroflex Cupertino, 10411 Bubb Rd, Cupertino, CA 95014. The BOA will cover a five year period to procure signal generator hardware, software, spares, repairs, upgrades, modifications, and technical and engineering services for the Counter-Radio Controlled Improvised Explosive Device Electronic Warfare devices in use at this time. A commercial solicitation will be issued using other than full and open competition to Aeroflex Cupertino IAW FAR 6.302 and statutory authority 10 U.S.C. 2304(c)(1). The basis for restricting competition is the proprietary nature of the technical data for the system resulting in a lack of drawings and specifications, in addition to duplicative costs and time that would be required to reverse engineer the system. The proposed BOA is for supplies and services for which the Government intends to solicit and negotiate with only one source, Aeroflex Cupertino, under authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. The basis for restricting competition is the proprietary information of Aeroflex Cupertino, form, fit, and function compatibility and the duplicative cost to the Government to utilize another source to satisfy the Government's requirements.Interested parties may respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed BOA based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
