All responsible sources may submit a bid, proposal, or quotation whichshall be considered by the agency. Based upon market research, the Government is not using policiescontained in Part 12, Acquisition of Commercial Items, in itssolicitation for the described supplies or services. However, interestedparties may identify to the contracting officer their interest andcapability to satisfy the Government's requirement with a commercialitem within 15 days of this notice. IAW IG5305.207(c)(91)(3) Note H: Caution: The drawings which will befurnished under this RFP and any resultant contract are proprietary tothe Boeing Company. Proprietary Firms interested in proposing on thisRFP must have on file a Data current OC-SAF/66, "Rights GuardCertificate", signed by an individual authorized to bind your company,or the bid package will not be furnished. This certificate may beobtained from OCALC/PKXDA, Tinker AFB OK 73145-5320. It is suggested that small business firms or others interested insubcontracting opportunities in connection with the describedprocurement make contact with the firm(s) listed.Data is claimed to be proprietary to Boeing and is protected under the"Government Purpose License Rights" (GPLR)The right of the government, to use that data to purchase this part fromadditional sources has been established under the "Government PurposeLicense Rights", settlement agreement in CL. CT.#309-89C., to providethe DOD procuring agencies the use of the data claimed to be proprietaryby Boeing for competitive reprocurement of replenishment spares. Award will be made only if the offeror, the product/service, or themanufacturer meets qualification requirements at the time of award inaccordance with FAR clause 52.209-1. The solicitation identifies theoffice where additional information can be obtained concerningqualification requirements are cited in each individual solicitation.This part required engineering source approval by the design controlactivity in order to maintain the quality of the part. Existing uniquedesign capability, engineering skills, and manufacturing knowledge bythe qualified source(s) require acquisition of the part from theapproved source(s). The approved source(s) retain data rights,manufacturing knowledge, or technical data that are not economicallyavailable to the Government, and the data or knowledge is essential tomaintaining the quality of the part. An alternate source must qualifyin accordance with the design control activity's procedures, as approvedby the cognizant Government engineering activity. The qualificationprocedures must be approved by the Government engineering activityhaving jurisdiction over the part in the intended application.
