- National Labor Relations Board Limited Source Justification and Approval under FAR Subpart 8.405 - 6 Renewal of Form Finder Maintenance and Support 1. Identification of Agency and the contracting activity National Labor Relation Board (NLRB), Office of the Chief Information Officer (OCIO) and Office of AdministrationlAcquisition Management Branch (AMB). 2. Nature and/or description of action being approved It is recommended that the National Labor Relations Board use Limited Source Justification and Approval under FAR Subpart 8.405 - 6 for the acquisition of the supplies or services identified below. 3. Description of supplies or services The scope of work for this task order contract is to provide upgrades and updates to FormSoft's Single Server FormFinder for the Web (Enterprise Edition) license annual maintenance and support subscription under vendor's GSA single award contract no. GS-35F-0468L. 4. Statutory Authority The primary statutory authorities for the MAS program are Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, etseq.) and Title 40 U.S.C. 501, Services for Executive Agencies. FAR Part 8.405-6 (b) (1) Only one source is capable of responding due to the unique or specialized nature of the work. 5. Contractor's Unique Qualifications or Rationale for the Nature of the Acquisition Requiring Use of Authority Cited The Agency has been using this software for several years and the vendor FormSoft Group is the manufacturer and sole supplier of FormFinder Web products including maintenance and support subscriptions. 6. Description of the Efforts Made to Ensure That Offers are Solicited From as Many Potential Sources As Is Practicable. We have previously performed market research to find alternate sources but no suppliers were found. A letter from the manufacture is attached to show that the vendor is the sole supplier of the product and services. Determination of Fair and Reasonable Pricing The total price charged for the required maintenance and support services is $8,550 which is the same as last year's price and is determined to be fair and reasonable. 8. Market Research We have previously performed market research to find alternate sources but no suppliers were found. A letter from the manufacture is attached to show that the vendor is the sole supplier of the product and services. 9. Supporting Facts not applicable 10. Page3 of3 CONTRACTING OFFICER'S CERTIFICATION I hereby certify that the above Justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge, information and belief, and hereby determine, based on the above findings, that NLRB's minimum needs or schedule requirements or other rationale for other than full and open competition used to formulate a basis for this Justification are complete and accurate. In addition, I hereby certify that the determination to use this procurement method is the most advantageous way to fulfill NLRB's need, that price and other considerations have been taken into effect, that sufficient funds are available, that the prices proposed are fair and reasonable and that therefore it is in the best interest of the NLRB to award this Contract/Purchase Order on a Other Than Full and Open Competition basis, given that competition of this requirement is not feasible or practical at this time.
