DRAFT SOW - WCRC Recompete (Ver. 2/18/2010) Questions & Answers resulting from RFI notice. PRESOLICITATION NOTICE: Workers' Compensation Review Contractor (WCRC) Re-competition. IAW FAR 5.205 (f) entitled, "Section 8(a) competitive acquisition". "When a national buy requirement is being considered for competitive acquisition limited to eligible 8(a) concerns under subpart 19.8, the contracting officer must transmit a synopsis of the proposed contract action to the GPE. (FedBizOps) The synopsis may be transmitted to the GPE concurrent with submission of the agency offering to the Small Business Administration (SBA). The synopsis should also include information - (1) Advising that the acquisition is being limited to eligible 8(a) concerns; (2) Specifying the North American Industry Classification System (NAICS) code; 524298 -Other Insurance Services (3) Advising that eligibility to participate may be restricted to firms in either the developmental or the developmental and transitional stages; and (4) Encourage interested 8(a) firms to request a copy of the solicitation as expeditiously as possible. Description: The Centers for Medicare & Medicaid Services Office of Financial Services Group (FSG) is seeking a qualified 8(a) contractor to perform the services outlined within the Statement of Work, entitled, "Workers' Compensation Review Contractor (WCRC)". (Please see addendum-1 to this announcement for revised statement of work text.) The WCRC shall, IAW CMS guidelines, and acting as an impartial entity, evaluate workers' compensation Medicare set-aside arrangement (WCMSA) proposals, and independently project the future medical costs, including prescription drugs, related to the workers' compensation (WC) injury, illness, or disease, that would be otherwise reimbursable by Medicare. The WCRC will utilize, and work within, the CMS-developed and owned Workers' Comp Case Control System (WCCCS), an electronic distributed case & correspondence database system, on a distributed basis from the New York City host server; as well as the RedBook prescription pricing tool. CMS will provide internet interface for the contractor's use. The contractor shall, upon reviewing each complete WCMSA proposal(case), recommend the WCMSA dollar amount for each proposal, and which is subsequently reviewed and approved/rejected by CMS final determination. For staffing and other resource considerations, the contractor shall anticipate receiving and completing, 2000 - 2500 WCMSA proposals per month. All contractor personnel are subject to background investigation, and pass a criminal background check. There will be four (4) key positions, for which CMS has right of personnel approval. In addition, contractor shall be required to perform outreach, or educational activities and contribute technical input, worker's comp technical information to CMS. Contractor shall track and capture metrics and report monthly on activities. The contract shall have a 2-3 month transition period, 12 months base performance period and four each individual 12-month option periods, each option to be exercised at the discretion of the Government. 17.
