- Amendment No. 4 is hereby issued to to answer the following questions. 1. In Supplementary to Form 1442 option no. 2 requires additional photovoltaic panels in the same area as the additional trellis in option no. 7. Are the panels going to be installed on top of the Trellis ? If not, the Total Evaluated Offer has to include one or the other. Please clarify. ANSWER: The option deletes the trellis and adds the photovoltaic panels. As such, the option price needs to account for a credit for the trellis. 2. Could you please confirm if the item in section 03 3000 Paragraph 3.9.F.1 "Hot-Weather Placement" will be in effect in the project? A NSWER: The requirements of paragraph 3.9.F.1 of Specification Section 03 3000 are applicable for this project. 3. On page 4 of the CCC, item 12, "FAR 52.236-76 Permits and Responsibilities (11/91)", it is stated: "The Contractor shall"..."be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work." a. Is a Construction Permit [CP, issued by the Puerto Rico Permits and Regulations Administration ("A.R.P.E."), required for this Solicitation Answer: The Contractor is to determine the permit requirements. i.What is the status of the CP? What is the status of the CP? Answer: The Government did not apply to any local permits. 4. Has ARPE issued a Notice of Approval ("Notificación de Aprobación") for this Solicitation? Answer: The Government did not apply to any local permits. 5. Can the offerors assume that all local government (State and Municipal) permits and endorsements required for the construction of the project under this Solicitation (besides those typically obtained after contract award, i.e., solid wastes, air quality, erosion control, and emission source permits), have already been issued, and that all the requirements and conditions included in such permits and endorsements are contained in the contract documents? Answer: Government did not apply for local permits or endorsements - Contractor to determine permit requirements. 6. On page 17 of the CCC, item 41, "FAR 52.236-14-Availability and Use of Utility Services (4/84)", it is stated: "Unless otherwise provided in the contract, the amount of each utility service consumed shall be charged to or paid for by the Contractor at prevailing rates charged to the Government..." a. What are the prevailing rates charged to the Government for utility services (water, sanitary sewer, and power)? Answer: Contractor to provide temporary utility services as required and should consult with utility services for rates. 7. On page 26 of the CCC, item 56 "GSAM 552.246-71-Source Inspection by Government (6/09)", paragraph (a), it is stated: "Supplies to be furnished under this contract will be inspected at source by the Government before shipment from the manufacturing plant or other facility designated by the Contractor, unless the Contractor is otherwise notified in writing by the Contracting Officer or a designated representative."  On the other hand, on the same page of the CCC, item 55 "FAR 52.246-12-Inspection of Construction (8/96)", paragraph (e), it is stated: "The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests", i.e., Government inspections and tests at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract, "as may be required by the Contracting Officer." a. Most of the materials and equipment required under this Solicitation are manufactured outside of Puerto Rico.  Moreover, some of such materials are manufactured in foreign countries, such as England and Italy.  Please confirm if the Contractor will be required to provide facilities, labor, and material reasonably needed to perform source inspections before shipment at places outside of Puerto Rico and/or at foreign countries. Answer: see material and product specifications for minimum inspection requirements. 8. On page 10 of the ARRAC, "FAR 52.225-23-Required Use of American Iron, Steel, and Other Manufactured Goods-Buy American Act-Construction Materials Under Trade Agreements (Aug 2009)", paragraph (b), it is stated: "The restrictions of section 1605 of the American Recovery and Reinvestment Act of 2009"..."and the Buy American Act"..."do not apply to Recovery Act designated country construction material.   Consistent with U.S. obligations under international agreements, this clause implements: (i) Section 1605 of the Recovery Act by requiring, unless an exception applies, that all iron, steel, and other manufactured goods used as construction material in the project are produced in the United states; and (ii) the Buy American Act by providing a preference for unmanufactured domestic construction material." a. Please clarify if the materials/equipment specified in the contract documents which are manufactured outside of the United States, comply with the requirements of Section ARRA as mentioned above. Answer: None of the products specified are made exclusively outside the U.S. 9. On page 2 of Section 01050 "Partnering", paragraph 1.01 B.3.(b), it is stated:  "The location for the retreat will be off site, in the Hato Rey area of San Juan Puerto Rico."  Further under this Section (1.01 C.), it is stated: "The costs of the Partnering process, including the costs for hiring the facilitator and rental of the facility, are to be shared by the Government and the General Contractor.  The Contractor shall pay for the cost of the conference facility for the partnering session, (including lunches and refreshments)"... "Approximately 25 to 30 participants can be expected to attend these sessions." a. Will the Contracting Officer consider other locations within the San Juan area for the retreat? Answer: Yes, CO will consider other areas within the San Juan area. 10. On page 6 of the SC, Part 9. Working Hours, paragraph A., it is stated: "Normal Working Hours are between 06:00 AM to 07:00 PM, Monday through Friday.  All work shall be performed during Normal Working Hours..." a. Concrete pours in the Hato Rey area where the Project is located normally start very early in the morning (around 4:00 AM).  The reason for starting concrete pours at this time is to avoid the high temperatures of the late morning hours, and to avoid delays in the delivery of the concrete material to the project due to the heavy traffic that occurs in Hato Rey after 6:30 AM. i. Will concrete pours and other related works be allowed outside Normal Working Hours? Answer: Yes, concrete pours and other related work will be allowed outside normal working hours. 11.   In regards to the Technical Specifications, Sections 23 0800 (Commissioning of HVAC) and 26 0800 (Commissioning of Photovoltaic System) make reference to a "Schedule of Allowances".  Both Sections state (on item 1.4) that: "Labor, instrumentation, tools, and equipment costs for technicians for the performance of commissioning testing are covered by the "Schedule of Allowances" Article in Division 01 Section "Allowances". a. There is no "Allowances" Section on Division 01.  Please issue the "Schedule of Allowances". Answer: Cost of all commissioning shall be included in the lump sum contract price, specs to be revised by amendment. 12.   Please clarify if any exposed concrete members' finishes include cement plaster and/or paint. "Exterior Stucco" and "Cementitious Finish" on concrete is primarily limited to areas at or near grade. Also refer to Specification Section 03 3300 paragraph 3.1.C.8 for finish requirements of Architectural Concrete. See Architectural drawings for extent and locations. Division 26 of the Technical Specifications describes the Lightning System for the facility, but there is no design shown on the Electrical Drawings.  Please clarify. Answer: The lightning protection system must be designed by the lightning protection Master Label contractor. This is the industry standard. The system is being bid based on building plans and a specifications. 14. On page 6 of the Geotechnical Engineering Study (GES) prepared by Langan Engineering and Environmental Services for this solicitation, dated November 6, 2009, it is stated: "We request the Architect and Structural Engineer provide plans for our review and comment". Please confirm if the bid drawings and technical specifications were delivered to the Geotechnical Engineer (GE). In the event that such drawings were delivered to the GE, please confirm if the GES remains unchanged. ANSWER: The architectural and structural plans were provided to Langan (the GE), and Langan participated in the preparation of the earthwork specifications. The statement that the question refers to was included in the section of the report discussing drainage behind retaining walls. We have reviewed the applicable portions of the plans and have confirmed that the drainage recommendations provided in our report were implemented in the project plans. We also would like to call attention to the fact that the retaining wall to be constructed as part of the security improvements was also addressed as part of an additional subsurface investigation, the results of which were presented in a 22 January 2010 letter-report by Langan. 15. Is it acceptable to substitute the engineered backfill required under footings, with a 4" lean concrete layer? Answer: We would like to take this opportunity to clarify the footing subgrade preparation requirements. There are two footing subgrade preparation procedures. One for the parking garage footings, and one for the anti-ram wall footing. The parking garage footings are to be supported by the stiffer portions of the underlying Stratum 2 clayey materials, and it is expected that this material will be present (without the need for over-excavation) on most of the site at the minimum bottom of footing elevation recommended in our report and incorporated into the structural plans. However, in the case that the stiffer portions of the Stratum 2 materials are not reached underneath a particular footing, an over-excavation until reaching the proper bearing material will be necessary. As recommended on the geotechnical engineering report, the over-excavated depth could be backfilled with properly placed and compacted engineered fill. Please note that the over-excavation is not expected to be thicker than 1 to 2 ft based on the conditions observed at the boring locations, and we request to be notified if deeper over-excavations are necessary. If the backfilling will be done using engineered fill, the excavation sides should be enlarged by 1 ft on all sides, relative to the footing dimensions. Alternatively, the backfilling could be done with lean concrete, but the thickness would depend on the actual depth of over-excavation vs. the proposed bottom of footing elevation. Another option would be to pour those footings with an increased thickness and bearing directly on the proper bearing material. The over-excavation below the anti-ram footing cannot be shallower than 1 ft, followed by the recommended proofrolling at the subgrade of the over-excavation. Lean concrete could also be used to replace the engineered fill that would be necessary to backfill the over-excavation underneath the anti-ram wall footing, but would need to be 1 ft thick.
