- The National Institute on Drug Abuse (NIDA), Office of Acquisitions Station Support Simplified Acquisitions Branch on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate, on a sole source basis, with BD Biosciences, San Jose, CA 95131, for preventive maintenance services for the LSR II instruments. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority of FAR 13.106-1(b)(1) and FAR 13.501 (a)(1) to use Simplified Acquisition Procedure for commercial items. The North American Industry Classification System Code is 811219 and the business size standard is $7.0 million. This is a firm fixed price acquisition. The period of performance is twelve months from award date. Place of performance is in Bethesda, Maryland. The NINDS Viral Immunology and Intravital Imaging Unit laboratory presently utilizes a custom digital flow cytometer (LSR II) manufactured by Becton Dickinson (BD) Biosciences to analyze cell suspensions. This instrument is equipped with four (4) lasers and thirteen (13) photomultiplier tubes (or detectors) as well as other sophisticated circuitry and mechanics. It is essential that the lab obtains the maintenance services from BD Biosciences to keep the instrument running and to receive the software upgrade it needed. The maintenance services and software upgrade to the customized instrument LSR II can only be obtained from the manufacturer BD Biosciences which includes the following: 1) two preventive maintenance inspections, 2) Software Revisions, 3) Unlimited service visits, Monday - Friday, 4) Unlimited telephone support for instruments, reagents, and applications, at no additional charge, 5) Emergency onsite support. No other suppliers can satisfy the agency's requirement and provide the required level of support and a comprehensive understanding of the LSR II. To use services provided by a vendor other than BD Biosciences will jeopardize the manufacturer warranty on the instrument. It is therefore determined that BD Biosciences is the only qualified vendor to provide the required services. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the government will consider response submitted on or before 2:00 PM E.T., February 4, 2010 to Liem T Nguyen, ln18x@nih.gov. All information furnished must be in writing and must contain sufficient detail to allow the government to determine if it can meet the above unique specifications described herein. A determination by the government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award from the NIDA vendor must be registered in the Online Representations and Certifications Applications (ORCA) at http://orca.bpn.gov. In addition, vendor must be registered in the Central Contractor Registration (CCR) at www.ccr.gov. Please reference announcement number 1424252 on all correspondence
