- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Combined Synopsis/Solicitation RFQ VA-247-10-RQ-0059 is issued as a request for quotation (RFQ). This requirement is subject to the availability of funds. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38. This acquisition is solicited on an unrestricted basis for NAICS 339113, size standard 500 employees. All responsible sources may submit a quotation which shall be considered by the agency. Federal Acquisition Regulation (FAR) provision 52.211-6 Brand Name or Equal applies to this acquisition. Vendors shall comply with FAR provision 52.211-6 if submitting other than the brand name products. Award will be all or none.The requirements of this solicitation is for Fusion ENT Navigation System, Fusion ENT Instrument Set, Surgeon Mouse Bags (15 pack), NIM Response 2.0 System, US 2/stand. Delivery is to the VAMC 6439 Garners Ferry Road, Columbia, SC 29209-4954, FOB Destination. FAR provision 52.212-1 [Instructions to Offerors Commercial] applies to this acquisition to include the following addenda: All vendors are cautioned that if selected for award, they must be registered with the Central Contractor Registration (CCR) program. The CCR can be accessed at Internet address: www.ccr.gov/. Confirmation of CCR registration will be validated prior issuance of an order. Evaluation of Quotations: a. The Government will issue an order resulting from this solicitation to the responsible contractor with satisfactory past performance whose quote, conforming to the solicitation, is Lowest Priced, Technically Acceptable. Award will be on an all or none basis. The following factors will be used to evaluate quotes: Technical acceptability and price. Technical acceptability: If providing an equal item(s), comply with FAR Clause 52.211-6, Brand Name or Equal. Explain how your company will meet the salient characteristics of the items as specified in the solicitation. Vendors shall submit quotes to the following address: Central Alabama Veterans Healthcare System Contracting Office Att. James A. Rose 215 Perry Hill Road Montgomery, AL 36109 Quotes must be submitted to the mailing address above; by fax: (478) 274-5866, Attn: James A. Rose or email: james.rose3@va.gov. The following FAR provisions and clauses apply to this solicitation: FAR 52.211-6 [Brand Name or Equal]; 52.212-4 [Contract Terms and Conditions Commercial Items]; 52.212-5 [Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items] with the following sub-clauses: 52.232-33 [Payment by Electronic Funds Transfer ---- Central Contractor Registration (OCT 2003). (a) The terms "bid" and "bidders", as used in this clause, include the terms "proposal" and "offerors". The terms "invitation for bids" and "invitation", as used in this clause include the terms "request for quote" and "request". (b) If items called for by this invitation for bids have been identified in the schedule by a "brand name or equal" description, such identification is intended to be descriptive but not restrictive, and is to indicate the quality and characteristics of products that will be satisfactory. Bids offering "equal" products (including products of a brand name manufacturer other than the one described by brand name) will be considered for award if such products are clearly identified in the bids and are determined by the Government to meet fully the salient characteristics and requirements listed in the invitation. (c) Unless the bidder clearly indicates in his/her bid that he/she is offering an "equal' product, his/her bid shall be considered as offering the brand name product referenced in the invitation for bids. (d) (1) If the bidder proposes to furnish an "equal" product, the brand name, if any, of the product to be furnished shall be inserted in the space provided in the invitation for bids, or such product shall be otherwise clearly identified in the bid. The evaluation of bids and the determinations to equality of the product offered shall be the responsibility of the Government and will be based on information furnished by the bidder or identified in his/her bid as well as other information reasonably available to the purchasing activity. To ensure that sufficient information is available, the bidder must furnish as a part of his/her bid all descriptive material (such as cuts, illustrations, drawings, or other information) necessary for the purchasing activity to: (i) determine whether the product offered meets the salient characteristics requirements of the invitation for bids, and (ii) establish exactly what the bidder proposed to furnish and what the Government would be binding itself to purchase by making an award. The information furnished may include specific references to information previously furnished or information otherwise available to the purchasing activity. (2) If the bidder proposes to modify a product so as to make it conform to the requirements of the invitation for bids, he/she shall: (I) include in his/her bid a clear description of such proposed modifications, and (ii) clearly mark any descriptive material to show the proposed modifications. (3) Modifications proposed after the bid opening to make a product conform to a brand name product referenced in the invitation for bids will not be considered. (End of Clause) FAR: 52.232-18 -- Availability of Funds. Funds are not presently available for this contract. The Governments obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. (End of Clause) The closing date and time of this solicitation is January 22, 2010, 4:00 p.m. CST. Submit quotations, signed by an authorized company representative by the closing date and time. Quotes may be submitted via mail, fax, or e-mail.
