- Added 01/07/2010: Q. Are companies under the 8(a) STARS program considered for this opportunity? A. Any company that is current 8(a) can submit a proposal. However, this award will not be cut under the STARS contract and STARS terms and conditions will not apply. Q. Is this an open RFP or its only for vendors short listed in the RFI? A. This RFP is open to any qualified current 8(a) vendor. Q. When is the last date for submission? A. January 28, 2010 at 11:59pm EST Q. A Firm Fixed Price contract seems inappropriate for a Small Business, particularly when Task 1 involves Requirements Gathering to propose a <software> solution. Did DOL mean for the contract to be a Time and Materials contract with Firm Fixed Price Labor Rates? A. This is designed as an FFP at our customer request. However, the question of consideration for a labor hour or time and material type contract for at least a partial amount of the requirement is with the customer for review. More to follow. Q. With reference to Section C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999), what is the government's process for extending a FFP contract? A. Assuming that the requirement is still needed by the Government and contract performance is satisfactory and both parties agree, the option is extended via modification to the contract. Q. Could you please detail any subcontracting restrictions? That is, as a 100% Small Business 8(a) Set-Aside, if our subcontractor's portion of the work exceeds $550K, are they required to submit a Small Business Subcontract Plan and will that plan need to be pre-approved by the SBA? (Per C.3 (5)(c)) of Section C.3 52.219-17 SECTION 8(a) AWARD (DEC 1996)) A. Any subcontracting work needs to be approved by the SBA. However a subcontracting plan is not required for a prime small business or their subcontractors. More information can be found under FAR Part 19.7 and 19.8. Q. Should the past performance questionnaire (filled by the offeror's past clients) be sent directly to your office? Or is it acceptable to be included with the proposal document? A. The past performance questionnaire needs to be sent directly to this DOL office. Q. The solicitation states that submissions may be made either via email or by hand-delivery to the DOL building [ ref: page 23, last paragraph ]. We assume the number of copies (1 original + 4 copies) and CD/DVD are applicable only for hand-carried responses and NOT for email submissions. Kindly confirm. A. Correct. EMAIL SUBMISSIONS ARE NOT ACCEPTED.
