Centers for Medicare & Medicaid Services Office of Acquisition and Grants Management 7500 Security Blvd., C2-21-15 Baltimore, MD 21244-1850 SOURCES SOUGHT/REQUEST FOR INFORMATION (RFI) RFI-CMS-#2010-100010 A. General Information: The Centers for Medicare & Medicaid Services (CMS) is seeking to identify certified 8(A) small disadvantaged businesses with capabilities or prior experience that can provide services as described within the draft statement of work (SOW), entitled, "Workers' Compensation Review Contractor (WCRC)". Additionally, we seek comments from all industry, relative to our DRAFT SOW. The Office of Financial Management-Financial Services Group (OFM-FSG), within CMS, in conjunction with its network of contractors, is responsible for ensuring: 1) that a complete and comprehensive evaluation and review of proposed Medicare (medical and pharmaceutical) set-aside arrangements is performed, and 2) determine if the proposed Workmans' Compensation Case settlement adequately protects Medicare's interests from future payments for Medicare covered services related to the work injury. CMS is seeking a Contractor: a. Capable of making independent determinations on 2000 cases per month (after an initial 2-3 month transition period), in order to maintain workflow within the existing WCCCS (Worker's Compensation Case Control System). Assist the CMS in responding rationally and fairly to a multitude of fact patterns presented by the submitters of set-aside arrangements. b. Capable of "ramping-up" the volume of independent monthly determinations to accomplish up to 2500 cases per month, for a limited time period(120days), in order to eliminate case backlog inventory. c. Capable of utilizing the existing CMS-provided distributed WCCCS to track individual case progress toward ultimate determination and closure. Create, capture, and track metrics of determinations and contract performance. d. To establish and standardize processes and procedures for orderly flow of information and decision making from submitters, through the WCRC, to the CMS Regional Offices, and back to the submitters, under the auspices of the CMS FSG Program Office. e. To establish, create and maintain its ability to identify, isolate, and expedite the processing of selected high-priority cases to address the special needs of the Medicare population. This includes cases with severe claimant financial hardship or catastrophic health problems and those with Congressional interest. f. To assist in the formulation and modification of policies and procedures for performance of the work. g. To suggest changes and improvements to the WCCCS, a distributed data system, built, hosted and maintained remotely. h. To support and assist CMS in responding to questions of fact or policy received from Congressional and other outside sources. i. Possessing business systems which are mature enough to identify, track and charge costs IAW generally accepted accounting practices (GAAP), and can estimate costs in the same manner in which costs are tracked and charged. The intent of this RFI is to: 1. Identify 8(A) DISADVANTAGED SMALL BUSINESSES which can demonstrate having and/or sourcing the necessary technical capabilities and expertise to perform the requirements of the attached Draft Statement of Work (SOW); and 2. Solicit and receive comments and questions from all industry on the attached Draft SOW. Comments and questions are encouraged from all business concerns (e.g. Small and Other than Small/Large). In addition to submitting a response to the RFI, the CMS encourages vendors to utilize the Federal Business Opportunities website (www.fedbizopps.gov) and register on the "Interested Vendors List" in order to promote teaming and/or prime and subcontractor relationships. B. Project Background: See attached DRAFT SOW C. Procurement/Contract Strategy: This RFI notice is not a Request for Proposal (RFP). CMS is considering a Cost type contractual arrangement under a forthcoming solicitation to be issued sometime in early/mid February 2010 with an award NLT September of Fiscal Year 2010. It is anticipated that the period of performance issued under a solicitation will be for a two/three -month transition period, a twelve-month base period and four one-year option periods, for a total five year effort. D. Capability Statement Requirements: CMS requests that respondents specifically address each of the areas identified below. This RFI is not a request for a technical proposal; however respondents should provide enough information for CMS to make an informed determination of a respondent's capability to perform the same or similar work as identified in the attached DRAFT SOW. RFI responses should include, at a minimum, the information identified in each of the following areas: 1. Respondents should describe their corporate capabilities as it relates to the same or similar work, as identified within the draft SOW. For example, the ability to understand technical program requirements and create innovative solutions to improve productivity and quality, as well as effectively communicate with and educate lawyers, employers, insurers, providers, suppliers, and beneficiaries is an integral part of the SOW. In addition, respondents should provide capabilities in understanding workers' compensation or similar cases, and/or making independent estimations of cost and responsibility. 2. Respondents shall demonstrate a working technical knowledge of the CMS Medicare Program and the Workers' Compensation community (audience) as well as documented knowledge, experience, and familiarity with the Workers' Compensation and/or Medicare fee-for-service programs and Medicare claims and payment systems, Medicare Administrative Contractors, Durable Medical Equipment Medicare Administrative contractors, intermediaries, carriers, providers, and the legal-liability determination community. 3. Respondents should demonstrate some corporate knowledge of medical and pharmaceutical review and cost/pricing. 4. Respondents shall describe abilities developing/deploying and/or utilizing a case control and/or content management system. They shall also describe their ability to track, recall, and manage the content of a variety of independent cases being developed and evaluated simultaneously. 5. Respondents shall demonstrate the capability to provide key/essential personnel who are highly qualified and are available to begin work immediately with short notice, in order to meet aggressive timelines.(Note: Interested parties should demonstrate the ability to staff up quickly, and have a corresponding training plan/ability.) 6. Respondents shall demonstrate the ability to provide the necessary facilities, infrastructure and business systems to immediately meet the contract requirements as identified in the attached draft SOW. Capability Statements and sow comments should be submitted separately, and received NLT COB -Monday, January 25, 2010. All Capability Statements should be submitted via email (receipt requested) -the preferred method, to: alan.fredericks@cms.hhs.gov. Please limit your capability documentation to the following Page Size, Font Type and Size, Spacing and Page Numbering. Responses shall be submitted using a Microsoft Word document with page size 8.5 by 11 inches. Font type shall be Times New Roman, size 10-12 using standard tabs and indent software features with no less than single spacing between lines. Responses should be limited to one (1) page answers for each of the individual areas stated in Section D (above) with a total of no more than ten (10) pages for the entire capability statement (not including descriptive/informative cover page, one-page resumes, and one page summations of each pertinent corporate experience). All pages should be numbered, starting w/page one. 4. All transmitted information marked proprietary shall be treated as such. Therefore, businesses should identify any proprietary information in their RFI response. Proprietary materials will neither be distributed, nor discussed with, any other organization. 5. Respondents should be aware that this RFI is for marketing purposes only and any responses thereto, or lack thereof, will not constitute a commitment by CMS to treat any potential offeror more or less favorably in the anticipated forthcoming solicitation and/or ultimate award. Please be advised that CMS will not respond directly to organizations submitting information in response to this RFI. The information received will be used solely to make an informed decision with regard to setting aside the procurement for Disadvantaged Small Business (8A) and to address DRAFT SOW issues that need clarification or revision. 6. Disadvantaged Small Businesses 8(A) are advised that within any joint venture, partnership, business combination, or prime/sub relationship -in order to be compliant with set aside rules, the 8(A) lead entity must perform a majority of the proposed work, which is defined as a minimum of 51% of total labor. 7. Parties interested in responding to this RFI and any subsequent Request For Proposal, must be aware that the ultimate Contractor selected to perform the SOW will represent the Government's interests and therefore must be mindful of complying with the requirements of Organizational Conflicts of Interest (OCI); if presently performing Workman's Compensation work in different capacities.
