- NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is F1M1G89327AQ01. The 437th Contracting Squadron, 101 E. Hill Blvd., Charleston AFB SC, requires repair and parts on Manual Reverse Osmosis Desalinators (52 each) The 437th Contracting Squadron intends to make an award to KATADYN NORTH AMERICA, MN 55427-3629. Market research was performed and information gathered in determining this company to be the only source for this requirement. In accordance with (IAW) FAR Part 5.207-15(ii) and FAR Part 6.302-1(b) (ii): The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source. This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. A determination by the Government not to compete with this proposal based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: KATADYN NORTH AMERICA, is the only company that can perform repairs on MROD equipment (NSN 4610-01-313-6086, MROD 35LA1). The service includes: Salt water flush and pressure tests, fresh water flush and biocide dip, repair internal leaks and replace seals, rebuild pump as needed, rebuild internal leaks and replace seals, replace membrane as needed, install new hoses and clean unit as needed. Visually inspect, repackage, and provide return transportations. Units are to be restored to meet original specifications. Service and repairs to be provided on a lot schedule, commencing on 13 January 2010 through 12 January 2011. Award shall be made in the aggregate all or none. AAFAR 5352.201-9101 Ombudsman (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, [Insert names, addresses, telephone numbers, facsimile numbers, and e-mail addresses]. (d) The ombudsman has no authority to render a decision that binds the agency.
