Description
THIS NOTICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. The Government is limiting consideration to General Service Administration Contractors, with a GSA Schedule contract Special Item Number(S), (70) INFORMATION TECHNOLOGY (IT), (541) ADVERTISING & INTEGRATED MARKETING SOLUTIONS (AIMS), AND (874) MISSION ORIENTED BUSINESS INTEGRATED SERVICES (MOBIS) (SIN) and 874. The Department of Health and Human Services intends to award a GSA Federal Supply Schedule contract. The purpose of this requirement is to provide technical support to the Office for Civil Rights (OCR) of the Department of Health and Human Services for the development and conduct of training courses and related materials to educate staff from the offices of state attorneys general and others about the Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy and Security Rules. BACKGROUND The OCR promotes and ensures that people have equal access to and opportunity to participate in and receive services from all HHS-funded programs without facing unlawful discrimination, and that the privacy of their health information is protected. OCR has primary responsibility for implementation and enforcement of the HIPAA Privacy Rule, which provides important health information privacy protections and rights for individuals. OCR’s enforcement activities include investigation of alleged violations and initiation of compliance reviews to determine compliance with the HIPAA Privacy Rule (45 CFR 160 and 164 Subpart E). OCR is committed to developing and enforcing strong health information privacy protections that do not impede access to quality health care. The Privacy Rule is one of a suite of regulations (including the Security Rule (45 CFR 160 and 164 Subpart C) and Standards for Transactions and Code Sets (45 CFR 160 and 162)) promulgated pursuant to the administrative simplification provisions of HIPAA. Through the American Recovery and Reinvestment Act of 2009 (ARRA), Pub. L. No. 111-5, § 13411, 123 Stat. 115, 276 (2009), Congress provided additional tools for enforcement of these administrative simplification requirements. Among other new provisions, ARRA authorizes a State Attorney General (AG) to bring an action on behalf of state residents to enjoin a defendant from further violation or to obtain damages. This new enforcement authority requires coordination between HHS and state attorneys general and provides HHS with the means to intervene in state actions. To assist state attorneys general in their efforts to exercise their new enforcement authority and promote productive and effective enforcement relationships with them, OCR will develop and convene a series of training seminars focused on enforcement of the HIPAA Privacy and Security Rules. OCR will also develop and make available the training in other modalities to ensure continuing access to the instruction. This request for proposals seeks a Contractor to provide support in the development and delivery of training and other outreach materials and tools in a variety of modalities. Classroom training seminars will be conducted by HHS staff, with logistical support from the Contractor. STATEMENT OF WORK/SPECIFICATION Purpose and General work Description The Contractor will assist OCR in conceptualizing and implementing a training curriculum for state attorneys general staff and others affected by the HIPAA Privacy and Security Rules. The Contractor shall submit for review to, and obtain approval from, the OCR Contracting Officer’s Technical Representative (COTR) all training and outreach materials prior to their use or dissemination. TASKS REQUIREMENTS Primary Requirement - OPENING MEETING: Within two weeks (14 calendar days) of contract award, the Contractor’s Project Director and other Contractor staff (as the Contractor deems appropriate) shall meet with the Contracting Officer’s Technical Representative (COTR) and representatives of OCR and other HHS offices (as determined by the COTR) to review the contract requirements and clarify/respond to any questions the Contractor may have Primary Requirement - DRAFT AND FINAL WORK PLAN: The Contractor shall prepare a draft work plan documenting the Contractor's approach to fulfilling the requirements of the contract and which details of the Contractor’s staff is responsible for each component of the effort, a detailed timeline containing key project milestones, including start and completion dates of individual tasks, and shall identify any initial decisions that are needed to initiate the project, including selection of graphics software. Primary Requirement - CURRICULUM DEVELOPMENT: The Contractor, based on a thorough analysis and understanding of current and projected training needs informed by input from the COTR and other subject matter experts and audience representatives selected or approved by the COTR, shall design and develop a comprehensive curriculum, which at minimum addresses the topics listed in Task 4, that addresses and meets short and long term training requirements for HIPAA privacy and security compliance and enforcement professionals at the beginning, intermediate and advanced levels Primary Requirement - COURSE STRATEGY DOCUMENT: CLASSROOM, SATELLITE, VIDEO, AUDIO, WEBCAST/OTHER COMPUTER BASED AND SELF-INSTRUCTIONAL COURSE DEVELOPMENT, REVISION, AND DELIVERY AND COURSE MATERIALS: The Contractor shall develop a course strategy document covering the design, development, delivery, and/or revision of a variety of self-instructional (SI) (e.g., audio or video), webcast or other computer-based, satellite and classroom courses consistent with the curriculum developed under Task 3. Primary Requirement - COMPUTER-BASED PRODUCTS PROTOTYPE DEVELOPMENT, REVISION, AND DELIVERY: The Contractor shall design, develop, deliver and/or revise a computer-based product prototype developed pursuant to Task 3 and the approved course strategy document, Task 4. Computer-based training and other products developed for the Internet shall conform to HHS Web Guidelines (see SOW Attachment Three) while also striving to maintain the users' interest by being interactive and challenging. Primary Requirement - GRAPHICS AND REPRODUCTION SUPPORT: The Contractor shall provide all technical graphics and reproduction needed to deliver the training course and other training materials developed in Tasks 4 and 5. Such support shall include development of any graphics, compact disk (CD), DVD, slides and/or overheads to support technical briefings, course calendars, course catalogs, and other presentation media (for example, posters, charts, and timelines) that may be required to support training and communications efforts. Primary Requirement - COURSE SESSION SCHEDULE, LOCATIONS AND SESSION CLASS SIZE: Initial Sessions and Location Within two weeks after contract award, the COTR will provide the Contractor, in writing, the schedule for the initial classroom sessions of the course. The first classroom session will occur in June, 2010; all sessions will be located at a governmental training facility in South Carolina. The Contractor shall have obtained OCR approval for Tasks 1 through 6 and be ready to support the first classroom session by June, 2010. Primary Requirement - PROGRESS REPORTS: As the work is conducted, the Contractor shall keep the COTR informed of significant problems or questions that arise, particularly ones that may affect the project timeline or completeness of deliverables Primary Requirement. Optional Requirement - ENHANCEMENTS: Task 9 is a time and materials optional line item. Requests by the COTR for implementation of enhancements to the computer based training modules will be made through technical direction letters (TDLs) provided to the Contractor by the COTR. Enhancements include changes to improve the user interface, changes to improve training module performance, and changes driven by updates to the laws and regulations. Optional Requirement - MAINTENANCE: Task 10 shall be performed under line items 0003, 0004 and/or 0005, Attachment Two. These are fixed price line items. Each Task 10 line item period of performance shall not exceed one year in duration. These are optional fixed price line items.
