- Justification for Other Than Full and Open CompetitionFAR 6.303-2 Content. (a)Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited. As a minimum, each justification shall include the following information: (1)Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." (3)A description of the supplies or services required to meet the agency's needs (including the estimated value). A service contract is required for the aforementioned equipment, see listing in line #2, above. (4)An identification of the statutory authority permitting other than full and open competition. FAR 6.302-2, Unusual & Compelling Urgency and FAR 6.302-1, Only One Responsible Source (5)A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Justification: The aforementioned Mark of Distinction Mailing Equipment here at the VANTHCS, was designed for, and implemented for our direct application. All software, software repairs, and patches are proprietary to the aforementioned vendor. To the best of my knowledge, VANTHCS mailing system, is unique unto Itself. No third-party parts, or software/firmware are compatible with the aforementioned equipment in use at the VA North Texas Health Care System. (6)A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Solicitation Procedure: Due to the applicability of both FAR 6.302-1 and FAR 6.302- 2 (exception number (a)(2)), no solicitation notice will be posted for this acquisition. (7)A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Cost to the Government is considered very fair and reasonable. (8)A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Market Research: Market research revealed and to the best of my knowledge that the required aforementioned justifications are available on the open market and only through Mark of Distinction. (9) Any other facts supporting the use of other than full and open competition, such as: No other supporting facts. (9)A listing of the sources, if any, which expressed, in writing, an interest in the acquisition. None that we are aware of, other than the aforementioned vendor. (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. None. (12) Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. Technical Certification Required by FAR 6.303-2(b): I certify that the facts and representations, of which I am cognizant, included in this justification form the basis for this justification and are complete and accurate to the best of my knowledge, belief, and ethical principles.
