- ERDC Contracting Office intends to solicit on a sole source basis under the authority of FAR 6.302-1 to FEI Worldwide Corporate Headquarters/FEI Company, 5350 N.E. Dawson Creek Drive, Hillsboro, OR 97124-5793. This procurement is being conducted under Simplified Acquisition Procedures only one responsible source and no other supplies or services will satisfy agency requirements. FEI Company is the only known source capable of meeting the Government's requirements due to the unique capability to provide suport and service for the microscope maintenance. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later 4:00 CST on Wednesday, 9 December 2009. Such capabilities/qualifications will be evaluated solely of determing whether or not to conduct this procurement on a competitive basis. A determination by the Government no to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. The Concrete and Materials Branch, Engineering Systems and Materials Division, Geotechnical and Structures Laboratory, US Army Engineer Research and Development Center has a requirement to maintain our Nova NanoSEM 630 - Serial No. D8855. It is used to study the chemical and physical properties of concrete and other materials on the nano/microscopic level. This request is in line with GSLs and ERDCs mission to support the Corps by performing research and development related to the nature of materials. The FEI Co., is the only vendor who can provide the service because they incorporate proprietary parts into their machine that no one else can provide. Furthermore, FEI Co., holds the patented technology and will not sell the parts to a third party in order for them to provide service on the instrument. Period of maintenance will begin after awarding of the contract for one year. Contract will include four- 4 -additional years -- option years.
