- THIS NOTICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THIS OPPORTUNITY IS ONLY AVAILABLE TO THE EVENTS MANAGEMENT OFFERORS ON THE DEPARTMENT OF HEALTH AND HUMAN SERVICES STRATEGIC SOURCING BPA's. The Department of Health and Human Services, Office for Civil Rights is seeking events management and facilitation services to obtain stakeholder input for development of guidance (under separate task order) on the Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy Rule’s requirements for de-identification of protected health information. The American Recovery and Reinvestment Act of 2009 (ARRA), Pub. L. No. 111-5, § 13411, 123 Stat. 115, 276 (2009) mandates publication of guidance created in consultation with stakeholders. The Privacy Rule is one of a suite of regulations (including the Security Rule (45 CFR 160 and 164 Subpart C) and Standards for Transaction and Code Sets (45 CFR 160 and 162)) promulgated pursuant to the administrative simplification provisions of HIPAA. The Office for Civil Rights (OCR) of the Department of Health and Human Services promotes and ensures that people have equal access to and opportunity to participate in and receive services from all HHS-funded programs without facing unlawful discrimination, and that the privacy of their health information is protected. OCR has primary responsibility for implementation and enforcement of the HIPAA Privacy Rule, which provides important health information privacy protections and rights for individuals. OCR’s enforcement activities include investigation of alleged violations and initiation of compliance reviews to determine compliance with the HIPAA Privacy Rule (45 CFR 160 and 164 Subpart E). OCR is committed to developing and enforcing strong health information privacy protections that do not impede access to quality health care. Through ARRA, Congress expanded the reach of the HIPAA Privacy and Security and made several changes to their standards and requirements. In addition, ARRA requires the Secretary, in consultation with stakeholders, to issue guidance on how best to implement the Rule’s requirements for de-identification of protected health information under 45 CFR § 164.514 (b). The procurement will be firm-fixed price and will be competed under HHS Strategic Sourcing BPA's. A competitive RFQ will be issued. The requirement will be funded in whole by the American Recovery and Reinvestment Act of 2009, and is subject to the reporting requirements of the Act.
