Description
This is a notice of intent, not a request for a proposal. A solicitation document will not be issued and proposals will not be requested. The National Heart, Lung and Blood Institute (NHLBI), has a requirement for the National Institute of Arthritis and Musculoskeletal, and Skin Diseases (NIAMS) of the National Institutes of Health (NIH) for a non-completive award to: Illumina, Inc., 9885 Towne Center Drive, San Diego, CA 92121-1975, USA, to purchase on-site emergency repair service, extended warranty, and preventive maintenance service agreement. This service agreement is for the BeadStation- serial number S457, LiHa-serial number 710001279 and Autoloader- serial# 11139-756, for the period of twelve (12) months, located at the NIH campus for NIAMS, Bethesda, Maryland 20892. The acquisition is being conducted under simplified acquisition using FAR 13 procedures and is exempt from the requirements of FAR Part 6, Competition Requirement. The North American Industry Classification System (NAICS) code is 811219 and Size Standard is $7.0m is applicable to this requirement. This Small Business set-aside does not apply. Illumina, Inc. is the manufacturer with no service distributors, therefore; only manufacturer certified skilled and knowledgeable technicians could perform preventative maintenance service. In order for the government to maintain its existing warranty on replacement parts, all parts must be compatible with existing equipment. This sole source acquisition therefore is justified under the authority contained in 41 U. S.C. 253 © (1) and FAR 6.302-1 (a) (2), states that: “When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirement full and competition need not be provided for.” The maintenance agreement will cover: 1) Illumina will provide on-site visit preventive maintenance according to the terms of the applicable Warranty, which may result in two to three days of system down time to Customer. 2) Illumina shall cooperate with Customer to schedule such preventive maintenance applications support visits as provided for in the Warranty Plan Summary are included in the price set forth in such Warranty. 3) Illumina’s technical support telephone line will be staffed by a support representative during the hours of 8:00a.m. to 5:00 p.m. Pacific Time, Monday through Friday, excluding holidays scheduled by Illumina (Normal Business Hours) for the BeadStation, LiHa, and Autoloader. 4) All labor and travel expenses associated with repair or replacement of items covered under service contract. 5) Parts replacement as required on the exchange or new part basis (at the sole discretion of Illumina, Inc.), excluding consumables and objectives. 6) This service contract includes one (1) preventive maintenance inspection per annual period (upon request by authorized NIAMS staff) three (3) day average on-site response time, critical and non-critical upgrades, demos, and applications training. 7) Certified engineers and application support from Illumina Inc. must perform all maintenance service. Interest parties may identify their interest and capabilities in response to this requirement. The determination by the Government not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct future competitive procurement. Responses are due by 3:30pm, December 4, 2009.
