- Evaluation Criteria Schedule of Pricing Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is being issued as a Request for Quote under the number RFQP07001000004. This solicitation document, incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-36. Upon request, the Contracting Officer will make their full text version available. Also, the full text version may be accessed electronically at: www.acquisition.gov/far. This action is unrestricted. The North American Industrial Classification System (NAICS) Code is 611430 - All Other Publishers with a Small Business Size Standard of $7.0 million dollars. A. BACKGROUND: The Federal Bureau of Prisons (BOP) has approximately 36,000 staff in more than 114 institutions geographically dispersed throughout the United States and Puerto Rico. Each institution is self sufficient with complex operations that are governed by Federal law and regulations, Occupational Health and Safety Administration (OSHA) laws and regulations, state law and regulation, where applicable; and DOJ and Bureau policies and procedures. B. CONTRACTOR REQUIREMENTS: The Contractor shall provide web based program on Occupational Safety and Environmental Law Resources. A summary of requirements for internet based media are as follows: Provide immediate and continual access to all Federal OSHA and environmental laws and regulations with updates as regulations or laws change. Provide access to all applicable state rules in instances where the EPA has delegated over site and implementation to the state level. Provide safety and environmental news updates. Provide accurate checklists for auditing safety and environmental activities. Provide self-automated training for areas under Federal OSHA and Environmental Laws. Provide training from experts in the OSHA and EPA areas via a web based platform. Provide record keeping for training completed by our agency's personnel. Provide lesson plans, instructor notes, classroom handouts, slides, and other teaching tools as appropriate for our staff to utilize in specialty training. TECHNICAL SUPPORT Technical support provided by the contractor shall include the following: --telephone support during regular working hours and for after hour emergency assistance; --correct software problems; --complete system software updates; --update and enhancement subscription; and --offer user's input into training topics for future support. --Provide and online venue for asking questions relating to OSHA and Federal Laws with a email response to question from a reliable source. PAYMENT OF SERVICES: Invoices shall be submitted at the beginning of the subscription renewal period to the payment office identified herein. Payment terms shall be Prepay for the ensuing subscription period. Payments shall be made in accordance with 52.232-33 Payment by Electronic Funds Transfer (EFT)-Central Contractor Registration (Oct 2003). MISCELLANEOUS INFORMATION: The contractor must understand that the Contracting Officer is the only person who can legally commit or obligate the Government to an expenditure of appropriated funds. The Contracting Officer is the only person who can legally change the terms or conditions of the contract and only then by written modification. The contractor shall immediately inform in writing, the contracting officer or appropriate Program Office staff of any adverse action taken by any licensing or regulatory body involving professional licensing. This includes, but is not limited to, suspensions, revocation, restrictions on practices. PRICING METHODOLOGY: You are hereby notified that an offer of contract award shall be extended to the responsive/responsible quoter submitting in accordance with FAR 52.212-1 (g). The quantity of supplies/services to be provided by the contractor is estimated in the Schedule of Items. These estimates are not a representation to a quoter or contractor that the estimated quantities will be required or ordered, or that conditions effecting requirements will remain stable or normal. Contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract. You are required to submit a completed copy of the Schedule of Items inclusive of the base year and all option periods. Pursuant to FAR 17.203(b), the Government's evaluation shall be inclusive of options. Pursuant to FAR 17.203(d), the quoter may offer varying prices for options, depending on the quantities actually ordered and the dates when ordered. TYPE OF CONTRACT: The Government contemplates the single award of a firm-fixed price Definite Quantity type contract resulting from this solicitation. The estimated date of award resulting from this solicitation will be made approximately January 3, 2010. PERIOD OF PERFORMANCE: The anticipated period of performance of the resulting contract will be as follows: Base Period: Date of Award through 12 months Option Period One: 13 months through 24 months Option Period Two 25 months through 36 months Option Period Three 37 months through 48 months Option Period Four 49 Months through 60 months Pursuant to FAR 17.203(b), the Government's evaluation shall be inclusive of options. Be advised that the Government has the unilateral right to exercise an option year in accordance with FAR 43.103(b) and 52.217-9, "Option to Extend the Term of the Contract" and 52.217-8, "Option to Extend Services." The Contractor will commence performance of this contract no later than 30 calender days from the effective date of the award of this contract.
