Billing Instructions This is a combined synopsis/solicitation for commercial items prepared in accordance with the format prescribed in Subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is RS-OIS-10-302, and it is being issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-34, effective 01 Jul 09. NAICS 511120 applies. The Small Business Competitiveness Demonstration Program is not applicable. This acquisition is being conducted under full and open competition. The U.S. Nuclear Regulatory Commission intends to award a firm-fixed price contract for electronic access subscriptions for Electronic Codes and Standards identified in the attached Statement of Work (SOW). The period of performance shall consist of one base year and four (4) one-year options. The requested access date for all items in the SOW is December 13, 2009. The following FAR provisions and clauses apply to this solicitation and are incorporated by reference: 52.212-1 Instructions to Offerors-Commercial Items; NRC ADDITIONAL INSTRUCTIONS TO OFFERORS To respond to this request, your organization will be required to provide an electronic or hard copy quote, which consists of a written technical quote and a price/cost quote. Number of copies: One original and one copy of your technical and price/cost quote. The offeror is also required to submit a copy of their quote via Electronic Format and CD. THE OFFEROR IS ALSO REQUIRED TO PROVIDE ANY LICENSE AGREEMENTS THAT APPLY TO ACCESSING TO THE REQUESTED CONTENT ELECTRONICALLY. Electronic Format - electronic versions of quotes shall be formatted with the products contained in Microsoft Office Professional 2003. Pricing spreadsheets shall be presented in Microsoft Excel 2003. NRC is not responsible for electronic difficulties and/or administrative problems associated with the transmission of any files to the NRC. PDF format is authorized and the documents may be sent by e-mail to Aaron.Alvarado@nrc.gov no later than the time and date established for submission. The closing date will not be extended for the purpose of responding to questions received after this date. 52.212-2 Evaluation-Commercial Items. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is low-priced and technically acceptable. Past performance will be evaluated to make a responsibility determination. The NRC reserves the right to query any databases (Ex. Past Performance Information Retrieval System - PPIRS.gov) that may contain past performance information of Offerors, or to obtain past performance information from any other source, as applicable. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 52.212-3 Offeror Representations and Certifications-Commercial Items Alternate I The offeror has completed the annual representations and certification electronically via the ORCA website at http://orca.bpn.gov. Omission of any requested items or technical specifications per the SOW will result in a technically unacceptable quote. Offerors are also required to submit at least (3) three references for past performance on contracts of similar size or scope to this procurement during the past three years. You are also required to identify any current/ former NRC employees who have been or will be involved directly or indirectly, in developing the quote, consultant agreement, or subcontract resulting from this quote (list name, title, and date individual left NRC and provide a brief description of the individual's role under this quote). If there are no current/former NRC employees involved, a negative statement is required. PRICE QUOTE Offerors shall fill in the attached Price Schedule Template for developing price quotes and shall include ALL items. The template is broken down into three different spreadsheets: (1) Standard Collection (pp. 1-2 of the SOW); (2) Custom Collection (pp. 3-6 of the SOW); and (3) Standard and Custom Summary. Incomplete price quotes will not be accepted. DISCLAIMER RFQ RS-OIS-10-302 will be distributed solely through the FedBizOpps website (http://www.fedbizopps.gov) The FedBizOpps website provides downloading instructions. All future information about this acquisition, including solicitation amendments will also be distributed solely through the FedBizOpps website. Hard copies of the solicitation document and its related documents will not be available. Because this RFP will be posted on this website, interested parties are instructed NOT to call, send letters, e-mails or faxes requesting the RFP. Interested parties are responsible for monitoring the FedBizOpps website to assure that they have the most up-to-date information about this acquisition. The NRC requires the prospective awardee to be registered in the Central Contractor Registration (CCR) database prior to award, during performance, and through final payment of the resulting contract in accordance with Federal Acquisition Regulation, 52.204-7, Central Contractor Registration. Processing time, which normally takes 48 hours, should be taken into consideration when registering.
