663-P00408________________________________________________________________________________________________________________________________________________ DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Medical Center 2. Description of Action: This is a request for other than full and open competition for the procurement of direct immunofluorescent (DFA) reagent kits for the detection of respiratory viruses (including influenza virus). 3. Description of Supplies or Services: This supply is integral in the performance of respiratory and influenza testing for VA patients. This is direct patient care product that directly supports health and well being for veterans. 4. Statutory Authority: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: This respiratory DFA kit is unique in its detection of respiratory viruses using a "wet" fluorescent antibody (FA) technique.This is a unique system that has no other comparable source. No other system uses the same unique proprietary reagents and no other system can detect some viruses detected with this system 6. Actions to Promote Competition: The contracting officer has researched and found no other vendor who can provide this DFA Kit. In the future the contracting officer will conduct additional market research for any new vendors which may be able to provide this product. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 1250.00 per kit. I have reviewed past purchase orders to determine price reasonableness. PO # 663-Q99684 dated October 2009 was for $1320.00 for a similar product. Based on this price, the contract specialist has determined the cost of this detection kit is fair and reasonable. 8. Market Survey (FAR 7.102): In accordance with FAR Part 10, market research was performed. The contract officer verified that Diagnostic Hybrids is the sole source manufacturer and distributor for this diagnostic item. This is a unique product that provides sensitivity and specificity not found in other platforms. Review of other platforms by in-house scientific experts has revealed that no other platform exhibits the performance characteristics necessary in our facility. 9. Other Considerations: This is a unique system. No other system is in existence that can perform the same testing. This product directly effects patient care and the community at large. 10. Listing of Sources the expressed, in writing, an interest in the acquisition: None. 11. Statement of Actions to Overcome Barriers to Competition: Prior to making a sole source award to this vendor in the future, the contracting officer will research the market by submitting a sources sought notice through GSA E-buy and Fed Biz Ops to insure no other vendors can offer this item. 12.
