- THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY NO SOLICITAION WILL BE ISSUED AGAINST THIS SYNOPSIS The purpose of this Modification 25 is to obligate $205,696 in funding in support of Work Assignment (WA 1-101; WA 1-103; and WA 1-104). The period of performance for Work Assignment 1-101 will be from May 11, 2009 through December 31, 2009. Funding for WA 1-101 is $979,000. The period of performance for Work Assignment 1-103 will be from June 15, 2009 through December 31, 2009. Funding for WA 1-103 is $287,696. The period of performance for Work Assignment 1-104 will be from October 9, 2009 through December 31, 2009. Initial funding for WA 1-104 is $36,000. WA 1-101 will have the contractor support EPA in efforts to help inform and coordinate Regional decision-making on requests for waivers for the requirements of section 1605 of the ARRA. The contractor shall provide technical expertise in assessing each individual waiver request's technical strengths and weaknesses. The contractor shall provide a summary report on each waiver request to help inform Regional decision-making on these requests. Work to be preformed under this contract shall include: • Collect and log all requests for waivers. • Evaluate waiver requests related to the purchase and installation of construction material and equipment for water and wastewater facilities to ensure waivers comply with one of the justifications under ARRA. • Evaluate construction cost estimates and develop detailed independent construction cost estimates when needed to evaluate waiver requests. • Prepare a report on each waiver documenting the steps taken in evaluating the waiver request and an analysis focusing on the individual waiver request's technical strengths and weaknesses. • Provide copies of all documentation used in the evaluation. • Develop a tracking spreadsheet database documenting each waiver request. Under Work Assignment 1-103 the contractor shall provide expertise and support to assist EPA's effort to assure an effective, legal and appropriate expenditure of ARRA funds to achieve the objectives of the economic stimulus through significant program implementation and oversight. Support tasks include assisting in: reviewing EPA Regional ARRA implementation efforts including oversight of State ARRA programs; developing fact sheets and questions and answers (Q&As) on key ARRA aspects and issues such as flexibility in set asides and needed testing of financial tracking approaches; and providing training to EPA Regional and State drinking water staffs on the latest Agency ARRA policies. Under Work Assignment 1-104 the contractor shall provide support to EPA Region 5 for the review of two Drinking Water State Revolving Fund (DWSRF) green project "business cases" in each of its six states to justify that projects qualified for the GPR under ARRA. The review of two green business cases from each state will help Region 5 achieve the goal of consistent oversight of the GPR requirement. A secondary objective is to provide technical assistance to states in their reviews of the information that has been submitted to them and is being used to create "business cases" which will qualify projects for the GPR. WA 1-104 will benefit the agency by advancing our goal of encouraging the development and implementation of projects that provide the social, health and environmental benefits to be derived from "environmentally green" projects under the green project reserve of the ARRA. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Water (OW) contracts were not awarded as FP contracts, they were awarded competitively, and each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OW contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OW contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA.
