Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is Q2360101000 and is issued as a request for quotation.. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-34. The associated North American Industrial Classification System (NAICS) code for this procurement is 541620 with a small business size standard of $7.0M. This requirement is a Small Business set-aside and only qualified offerors may submit quotes. The National Park Service requires the following items:Line item 001, 690 direct productive manhours, anticipated period of performance, effective date of contract through through - February 28, 2010. Pricing shall be submitted on a per hour firm fixed price.Line item 002, 310 direct productive manhours. Option item Anticipated period of performance March 1, 2010 through May 28, 2010. Pricing shall be submitted on a per hour firm fixed price. For this solicitation, the NPS intends to solicit firm fixed pricing and a brief technical proposal relative to providing the required services. The statement of work for these services are as follows:Contract Scope of Work Title: Policy and Regulatory Legal Assistance on Geologic Resource Management Issues Facing Units of the National Park System Description: The Geologic Resources Division is one of five divisions within the National Park Service (NPS)'s Natural Resource Program Center. The Division provides parks, regions, networks and the Washington Office with expertise on minerals management, disturbed lands restoration, geohazards, soil and geologic inventories, planning, and management of specialized geologic resources like cave and karst, fossils, and coastal resources. Legal assistance provided often requires the interpretation of statutes, regulations and case law, and the development of policy and guidance documents. At present, the number of issues warranting research and analysis outpaces the in-house capability of staff. As a result, the Geologic Resources Division seeks to obtain assistance from a Contractor in carrying out policy and regulatory research and analysis on several key issues. For example, at present, a key project the division is working on is the development of a rule making package to revise the NPS's nonfederal oil and gas regulations at 36 CFR Part 9, Subpart B. The NPS promulgated these regulations back in 1978, over 30 years ago. Over that time much has changed in the regulated community of oil and gas operators and in the sphere of the regulator. New scientific data, innovations in extraction and mitigation techniques, and alternative incentive programs have emerged underscoring the need for the NPS to improve how it handles the identification of potential impacts, available mitigation measures, and regulatory compliance requirements. As part of this rulemaking effort the NPS needs help in drafting regulatory language, carrying out regulatory compliance responsibilities, evaluating existing regulatory approaches being implemented by state and other federal agencies, addressing questions on evolving case law pertinent to the regulation of oil and gas operations, generating ideas on how to integrate and utilize new information technology in its permitting system in compliance with federal statutes and executive orders, and understanding how it can help mitigate the production of greenhouse gases at oil and gas facilities covered by its regulatory program in parks. Scope of Work: The NPS intends to award a contract to gain the support of a Contractor to prepare independent analyses and to provide legal expertise related to answering short-term questions related to geologic resource management issues. Independently and not as an agent of the Government, the Contractor shall provide the NPS with all labor, and services necessary to conduct the needed research and prepare the requested documents in electronic format. The Contractor must be locatdd withiin the commuting distance of Lakewood, Colorado. Specific research and analytical needs include the following: I. Renewable Energy Development 1.Development of a framework for collecting storing and displaying data regarding energy projects currently taking place, and proposed for future use, near units of the National Park System. Specifically, the contractor will collect, analyze and display such data for parks within the Pacific West Region and the Intermountain Region. 2.Develop fact sheets on issues related to the following renewable energy technologies: solar, wind, geothermal and hydrokinetics. The fact sheets will contain technical, environmental, legal and policy information for use by park resource managers. 3.Develop a report on the United States Forest Service's (USFS) permitting activities relative to renewable energy projects - both planned and already permitted projects on USFS lands. This report will include the following: a).A description of the regulatory framework,b).The identification of opportunities for NPS involvement in that process,c).The identification of areas open to renewable energy projects in proximity to park units, andd).Recommendations for action. 4.Provide assistance in the development of an energy website, designed for NPS staff. 5.Undertake discrete analysis on issues related to protecting park resources from energy development outside park boundaries. II. Non-Federal Oil and Gas The Geologic Resources Division has recently initiated efforts to revise its regulations at 36 CFR Part 9, Subpart B ("9B"). The NPS is currently preparing administrative notices, a Programmatic Environmental Impact Statement, and draft regulatory language. The Contractor shall: 1.Assist with drafting regulatory text. 2.Assist with carrying out rulemaking compliance responsibilities. 3.Develop and populate a digital administrative record on the rulemaking effort. 4.Develop an analysis of 109 existing access-exempt non-federal oil and gas operations as to where they are located relative to federal land in the boundary of a given park and the nature of the protection concerns raised by these exempt operations. 5.Prepare memorandums addressing an array of questions arising in the context of the rulemaking effort, such as, the scope of criminal penalties under federal statute, state bonding requirements, how other agencies track and deal with permit violators, mechanisms for allowing permittees to submit information in a paperless fashion, and case studies on the use of third party monitors of operations to assure compliance with regulatory requirements. III. Ocean and Coastal Park Guidance The NPS has recently completed a first draft of an Ocean and Coastal Guidance Handbook. This handbook discusses and explains NPS policy and regulatory power regarding various issues facing ocean and coastal parks. Such issues include commercial and recreational fishing, aquaculture, commercial and recreational boating, invasive species, recreation, water quality, sediment management, and sand rights. The Handbook is currently being reviewed by NPS staff as well as staff from the Department of the Interior's Office of the Solicitor. The Geologic Resources Division is currently receiving comments on the handbook. The Contractor shall: 1.Collect and analyze comments on the current draft of the Ocean and Coastal Handbook. 2.Research any and all questions raised in comments received. 3.Draft guidance language and include it in the Handbook. Quote MUST be good for 90 calendar days after close of RFQ. CCR Requirement & ORCA Requirement : Offeror must be registered in the Central Contractor Registration (CCR) database before an award can be made to them. If the offeror is not registered in the CCR, it may do so through the CCR website at http://www.ccr.gov. -- ORCA Requirement - Company must be registered on Online Representations and Certifications Application (ORCA) before an award could be made to them. If company is not registered with ORCA, they may do so by going to ORCA web site at https://orca.bpn.gov/ Commercial Items Terms and Conditions- The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.219-6, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.225-13, 52.239-1, FAR 52-217-07 (fill in 30 days), and FAR 52.222-54. Award Evaluation Factors Award will be made to the proposal that presents the best value to the Government considering the stated technical factors and price. Technical factors are listed in descending order of importance. Evaluation factors other than price, when combined are more important than price. 1.Corporate Experience and Knowledge in researching and writing reports and memorandum regarding the National Park Service's regulatory authority and the federal rulemaking process as applied within the Department of the Interior.2.Key Personnel Experience and knowledge of NPS policy and regulatory authority regarding ocean and coastal units of the National Park System.3.Corporate Knowledge of renewable energy technologies and potential park impacts.4.Key Personnel Degree in Natural Resources and Environmental Law & Policy.5. Past Performance is similar or related projects. Evaluation of the technical capability shall be based on the information provided in the proposal. The contractor shall present resumes of all personnel who are proposed to work under this contract. Resumes shall contain contact information for professional references, and information on work that candidates have performed on similar projects. Past performance information shall be provided for at least two sources. NPS reserves the right to judge the qualifications and previous work history of any individual proposed by the contractor for any position. Qualifications of Key Personnel Key contractor personnel must have a minimum of a law degree. An advanced degree is preferred (such as a Master of Laws (L.L.M. Degree) in Natural Resources and Environmental Law and Policy or equivalent experience. All services under this contract are required to be conducted by trained personnel who have the knowledge, skills, and abilities to provide services immediately and with no unnecessary delays. Key personnel are expected to have the appropriate legal training and background in addition to experience in a natural resource work environment to successfully complete the scope of work.
