- NAICS Code: 541620 The US EPA/OECA/OC/CASPD Compliance Assistance Policy & Integration Branch, under the authority of 31 U.S.C. ? 6303 and in accordance with the 41 U.S.C. ? 253, Competition in Contracting Act (CICA), is soliciting vendors interested in entering into a "no-cost" or"gratuitous services" contract to provide green practices case studies and success stories and an alternative navigation mechanism for EPA's Retail Industry Web Portal. The portal allows retailers to quickly find information they need to: 1) understand and comply with environmental regulations; and 2) voluntarily go beyond regulatory obligations to protect the environment for future generations. Retailers can now quickly find information to help them: buy and sell environmentally friendly products; create and maintain buildings that are environmentally responsible and resource-efficient throughout a building's life-cycle; reduce the impact of transportation related activities on the environment; and mitigate climate change by reducing energy consumption and greenhouse gas emissions in their own operations. In consideration of these services, the contractor may use the experience in working with EPA and resources developed under this contract to market their services to potential clients. In addition, the contract will include the following statement, requiring the contractor's assent to the same: **********************************************************************In consideration of the right to [insert task that contractor will be performing] under Contract No. XXX, the undersigned Contractor hereby expressly agrees to provide the subject services to the United States Environmental Protection Agency without charge or "gratuitously." It is understood and agreed that the Contractor will provide the aforementioned [describe services to be performed] free of charge to the United States Environmental Protection Agency and that no future compensation or claim related to said services will be due or expected. It is also understood and agreed that this Agreement in no way amends or modifies the terms and Conditions of Contract No. XXX. This Agreement does not violate the prohibition against "voluntary services" contained in 31 U.S.C. ? 1342 in that services furnished pursuant to a formal agreement are not considered voluntary services. 7 Comp. Responses should be no more than (5) pages in length and should describe in detail the vendors solution for the tasks listed in the Statement of Work. As the services received are not expected to be at a value more than the simplified acquisition threshold, the acquisition is set aside exclusively for small businesses. All interested small business firms may submit a quote. The NAICS code for this procurement is 541620. All responsible sources submitting a response, if timely received, will be considered by the Agency. Interested vendors will be responsible for the timely submission of their quote. Please include your name, point of contact, address, area code and telephone number, facsimile number, Dun and Bradstreet number, proof of registration in the Central Contractor Registration, GSA number, if applicable, and business size and classification (e.g., woman or minority owned; 8(a), etc.). Telephone requests or inquiries will not be accepted. Although the Federal Acquisition Regulation does not apply to this procurement, the following commercial clauses will be included as part of the no-cost contract: FAR 52.212-1 "Instructions to Offerors-Commercial," FAR 52.212-3 "Offeror Representations and Certifications - Commercial Items," FAR 52.212-4 -"Contract Terms and Conditions - Commercial Items" and, as applicable, FAR 52.212-5 "Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items." Quotes will be evaluated and award will be made to the contractor whose submission affords the best value to the Government: past performance and quality considered.
