Description
Sample contract This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation: proposals are being requested and a written solicitation will not be issued. Award is subject to the availability of funds. The solicitation number is 2010-N-11537 and this is a request for proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-36. The position solicited is a Senior Monitoring & Evaluation Advisor for HIV/AIDS for CDC located in Kampala, Uganda, under a Personal Services Contract (PSC). The Personal Services Contract is an employment contract between CDC and an individual. The PSC creates an employer-employee relationship that allows CDC to exercise supervision and control over the contractor performing the roles and responsibilities outlined in the contract. The PSC mechanism does not allow for hiring host country nationals or permanent legal residents of the host country, as these individuals must be hired thru the U.S. Embassy. Area of Consideration United States citizens, U.S. permanent residents, and third country nationals are eligible for this position. Citizens and permanent residents of the host country are not eligible under this solicitation. Security Clearance: OPM National Agency Check with Inquiries (NACI) Period of Performance The period of performance shall consist of one base period plus option periods for a total of 60 months. The solicitation, conditional offer, and clearance process takes about 4 months and the estimated start date is or on or about March 16, 2010. The actual period of performance will be identified at time of contract award, after the clearance process has concluded. The Effective Date will be coordinated in advance with the Contract Awardee and the funding program office before the contract is signed. Compensation and Reimbursement a. The Contractor shall be reimbursed on a bi-weekly basis for the period of performance. Reimbursement shall be based on a 40-hour work week to include leave and holidays. The salary range is $69,950 to $111,467 per year, dependent upon individual salary history, work experience, and education background. b. The Contractor is responsible for obtaining health insurance for the country of service (this is mandatory and upto 75% of premium cost is reimbursable) and life insurance (this is optional - upto 1/3 of the premium cost is reimbursable). Non-U.S. citizens must obtain Medical Evacuation Insurance which is 100% reimbursable. c. The contract shall be a Personal Services Contract (PSC) under the authority of 42 USC 242l(b)(8) which dos not allow domestic PSCs. d. Post Cost of Living Allowance, Post Differential, and Danger Pay rates, if any, as provided for in this contract may fluctuate. By signing a contract, the Personal Service Contractor agrees to be compensated based upon the then-current rates of these overseas allowances and differential for all U.S. Government civilian employees assigned to your location of assignment, as approved by the U.S. Department of State's Office of Allowances. These overseas allowances and differential may increase, decrease, or even be eliminated altogether during the life of the contract. Description/Work Statement Purpose: Job holder is a senior program specialist and key public health technical advisor to the official responsibilities for Monitoring and Evaluation of HIV/AIDS and other health program activities within CDC-Uganda. The main purpose of this position is to develop programs leading to the monitoring and evaluation of PEPFAR-funded programs, as defined in the PEPFAR Country Operational Plan (COP). Job holder works at a project management level to coordinate the design, implementation, and strengthening of monitoring systems and evaluation projects related to HIV/AIDS programs. At a technical level, incumbent ensures appropriate, high quality implementation of these systems and evaluate program results on a regular basis. Incumbent also works with USG partners at both implementer and national levels to quantify progress towards targets set for PEPFAR and the national HIV response. Job holder represents the agency on M&E issues at technical, policy and strategic planning meetings, including meetings with collaborators and donor agencies The senior M&E specialist works to strengthen systems and staff capacity at the MOH to collect, manage, and use quality M&E data to inform programs and policies in the national response to HIV and AIDS. The position also has responsibility for assisting the PEPFAR team in measuring the USG contribution toward achieving the Emergency Plan targets through MOH reporting systems, and to adapt PEPFAR-supported M&E and other Strategic Information (SI) tools to improve Emergency Plan programming and service delivery. Position serves as an anchor member of the Strategic Information Interagency Technical Team. I. Program Monitoring and Evaluation Management 75% Job holder is responsible for planning, designing and managing the M&E component of the agency's strategic objectives/country operational plan. To achieve results, job holder works directly with the host country Ministry of Health, international organizations, donors, non-governmental organizations, partners, contractors, and other USG agencies. "Project management of M&E activities" is defined in memoranda of understanding, cooperative agreements, grants, and/or contracts with implementing partners. Senior M&E Specialist works on behalf of CDC with the MOH to strengthen M&E capacity. Incumbent supports the MOH in their efforts to better plan and monitor programs using M&E and other strategic information. Assistance may include providing or facilitating training or technical assistance in data collection, data management, analysis, data use and dissemination. Programs may include Prevention of Maternal to Child Transmission, Counseling and Testing, Tuberculosis, and Home-based and HIV-related Clinical Care programs. Support also may be provided as needed to Treatment programs and to ensure HIV/AIDS program integration into the large national health management information system (HMIS). Senior M&E Specialist serves as the principal advisor to the Chief of the Program Monitoring and Evaluation Branch on M&E issues, challenges, and policy questions at the international and national levels. Incumbent is responsible for coordinating and facilitating dialogue and decision making on M&E issues within CDC, including identifying and recommending new technologies and methods for strengthening M&E systems in Uganda. Incumbent also is expected to work closely with USG partners to ensure that changes and advances in the MOH M&E systems are incorporated into all PEPFAR-supported activities. Position assists with the coordination of strategic planning, monitoring, and evaluation of programmatic activities of CDC/GAP, including the development of M&E plans in support of PEPFAR data needs. Incumbent works closely with CDC staff across HIV/AIDS technical areas supported by CDC, to ensure that data generated by the MOH M&E systems are useful and used for program planning, policy development, advocacy, and program evaluation. During specific periods of the year, the SI/M&E Specialist aids in the completion of the USG Country Operation Plan and the Semi-annual and Annual Report, as it relates to M&E activities. Monitoring: Incumbent provides expert technical assistance for program evaluation activities that focus on priority issues. In coordination with other program offices, develops innovative monitoring tools, where needed and appropriate, to include Data Quality Assessment tools. Works with the various entities to ensure activity work plans and monitoring plans include relevant and effective performance measures that together provide greater results and more accurate measurements. Ensures that data are properly collected, and that each indicator is an appropriate measure of its corresponding result. Advises and develops training on the process of defining measurable indicators and targets for the desired program results addressed by cooperating partners and assists them on their contribution to the monitoring portion of reports through regular consultations and specialized training. Works with partners to ensure their understanding of the performance monitoring system and process, and their role in the process. Advises them on specific measurement techniques appropriate for their programs. Provides information to personnel of other USG agencies on M&E concepts, processes, design, training, and practices. Evaluation: Designs the overall evaluation plan, following strategic objectives set for the M&E component of SI goals. Assists technical sections and partners with planning, designing, and implementing their respective and appropriate evaluation plans. Takes the lead in managing evaluations, and supports findings of relevance for more than one activity. Works closely with the host government to ensure that national-level data are available and reliable, and works on an inter-agency basis to ensure that USG results contribute to an accurate picture of the situation on the ground, that double-counting is avoided, and that results are truly attributable to PEPFAR program interventions. Has primary responsibility for development of the M&E section of agency's annual submission for future funding. General Program Management: Carries out management responsibilities for cooperative agreements, grants and contracts associated with monitoring and evaluation. Job holder provides technical direction for proposals that result in a grant, contract and/or cooperative agreement for M&E programs. This ensures consistency with PEPFAR policies and host country policies and regulations. Job holder oversees public health technical aspects in development of the Scope of Work, Funding Opportunity Announcement, Request for Application, or Annual Program Statement and reviews applications, supplemental awards, and requests for extensions for activities under his/her purview. Once grant/cooperative agreement/contract is in place, participates with implementing partners in the development of work plans for implementation of activities, oversees performance of cooperating partners/contractors, carries out technical reviews, reviews progress, identifies potential issues and informs supervisor, recommending actions for amelioration. II. Interagency Coordination 15% As a regional and international expert on matters pertaining to HIV/AIDS Monitoring & Evaluation (M&E) programs, job holder represents CDC-GAP Uganda at technical, policy and strategic planning meetings, including meetings with collaborators and donor agencies. Briefs senior agency officials, PEPFAR country team, and interested officials of other USG agencies, as appropriate, on the results of such meetings and prepares written reports for submission to other interested parties. Participates in inter-agency strategic planning and administrative meetings for purposes of discussing and developing evaluation targets for furthering the program. Such meetings may include representatives of other USG PEPFAR implementing agencies (Departments of State, Defense, Labor, Commerce, and Health and Human Services - including Centers for Disease Control and Prevention, National Institutes of Health, Substance Abuse and Mental Health Services Administration, Food and Drug Administration - USAID and Peace Corps). Serves as chair or rotating chair on inter-agency technical working groups to ensure effective coordination of work plan development, implementation strategies, and evaluation plans for all USG agency M&E activities in Uganda. Job holder serves on intra- and inter-branch and agency PEPFAR working groups and projects, frequently taking the project lead role. These projects are generally short-term in nature and most often have to do with special requirements for VIP visits, special PEPFAR taskings, etc. This would include three to four projects per year where position would have a lead role. Assists the Ministry of Health (MOH) in preparing and disseminating white papers, presentations and peer-reviewed journal articles, as well as writing national policy documents. As a consultant, job holder represents PEPFAR in the area of program SI/M&E and attempts to influence other collaborative organizations engaged in HIV/AIDS prevention programs to adopt appropriate SI/M&E strategies for their program activities. Prepares verbal briefings, presentations and written reports for agency leadership and staff as well as other interested parties on the progress of the country PEPFAR-funded M&E program activities. On behalf of the branch chief, incumbent may participate with other PEPFAR professionals on in-country committees for monitoring and evaluation issues. The purpose of such committees is to assess program needs and issues at the local level and develop strategies for communicating these needs/issues to the national level. The committees help to ensure consistency in the implementation of best practices for HIV/AIDS issues on a national level. Based on information received in the national committees, job holder may recommend revisions to the Branch and PEPFAR team program policies and guidelines for M&E. Additionally, incumbent shall be required to perform other duties as assigned by the agency that expand coordination and capacity building with host country national institutions and partners. III. Administrative Management 10% Incumbent maintains files and records in the M&E data collection specific to the activities/programs for which s/he is responsible. Responsible for data integrity and security of information in reporting databases that may relate to HIV/AIDS infection (particularly as related to named individuals). Other program files include reports, meeting summaries and minutes, copies of all grants/cooperative agreements/contracts, research determinations, panels, and awards. Whenever possible, these records are filed electronically and entered into the reference system. Prepares and occasionally presents briefings for Congressional and Executive delegations, industry leaders and other high-level visitors; participates in making arrangements for visits and serves as spokesperson, as required. Serves as control officer for some site visits for agency and inter-agency PEPFAR senior-level officials. Job holder is responsible for providing oversight of and monitoring the budgets allocated to M&E implementing/cooperative agreement partners within the job holder's portfolio. This includes reviewing budget requests for appropriateness; monitoring use of funds for adherence to proposed activities; quarterly pipeline reviews/budget status reports; following up on irregular findings; and, providing advice for realignments of budgets, accruals. Selection Factors: The applicant that represents the best value to the Government will be considered for award. To determine best value, the following factors will be considered: 1. Two years of that experience must be related to monitoring and evaluation of HIV/AIDS and/or health programs. Experience working in close collaboration with high level government and other counterparts required. Demonstrated knowledge of and experience with data management processes and tools, including web-based database systems, for large scale health or HIV/AIDS activities required. e) Language skills: Must have excellent written/verbal communication skills in English, and diplomacy. Level IV (fluent) English is required. f) Skills: Demonstrated ability to communicate both orally and in writing, to make clear, convincing arguments and justify recommendations. Demonstrated ability to analyze data and produce well-written reports and presentations using Word, Excel, and PowerPoint. Computer applications knowledge and ability to use advanced software programs for internal management and presentations. Desired Qualifications: a) Knowledge of the Organization: Thorough understanding about USG processes, procedures and policies related to the PEPFAR initiative; Government of Uganda's policies and guidelines on HIV/AIDS prevention, care and treatment; Uganda's National Strategic Plan for HIV/AIDS; Uganda's Health Sector Strategic Plan; Epidemiology of HIV/AIDS in Uganda; USG/ PEPFAR program activities on HIV/AIDS; Epidemiology of HIV/AIDS Uganda. b) Training: Post graduate training and specialty certifications are desired. c) Experience: Five years or longer work experience managing public health or other social sector programs in sub-Saharan Africa, with three years managing an HIV/AIDS program, is desired. Previous experience in providing training and/or mentorship in the field of M&E at an individual and group level is desirable. Experience working on M&E with one or more international agency systems in Eastern or Southern Africa, preferably with USG or UN agencies, is desirable. C. "Veteran-owned small business concern" means a small business concern- (1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and (2) The management and daily business operations of which are controlled by one or more veterans. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment. (D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code). (i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). (k) Certificates regarding exemptions from the application of the Service Contract Act. (Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services.) The offeror o does o does not certify that- (i) The services under the contract are offered and sold regularly to non-Governmental customers, and are provided by the offeror (or subcontractor in the case of an exempt subcontract) to the general public in substantial quantities in the course of normal business operations; (ii) The contract services will be furnished at prices that are, or are based on, established catalog or market prices (see FAR 22.1003-4(d)(2)(iii)); (iii) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract; and (iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers. (3) If paragraph (k)(1) or (k)(2) of this clause applies- (i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and (ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause. ( l) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to a central contractor registration database to be eligible for award.) (1) All offerors must submit the information required in paragraphs (l)(3) through (l)(5) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the Internal Revenue Service (IRS). (2) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror's relationship with the Government (31 U.S.C. 7701(c)(3)).
