Description

JUSTIFICATION AND APPROVALFOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of Only One Responsible Source and No Other Supplies Or Services Will Satisfy Agency Requirements pursuant to FAR 6.302-5, 38 U.S.C. 8127. Purchase request/solicitation number: 541-09-4-778-0164 1. Contracting Organization: The Louis Stokes Cleveland, Department of Veterans Affairs Medical Center, Brecksville, Ohio, 44141, VISN 10 Contracting Activity, Acquisition Management Service. II. Description of Action: The Contractor shall provide all labor, material, equipment, transportation and supervision necessary to provide service to pick up Platinum Electrophysiology (EP) Catheter Tips from used catheters and recycle and refine for the value of the Platinum. Payment will be issued to the LSVAMC, Cleveland. Total Cost: $ 0.00 IV. Authority: The statutory authority permitting use of noncompetitive procedures is as follows: 38 U.S.C.8127 to conduct sole source acquisitions with SDVOSB or VOSB's without competition as implemented by the Federal Acquisition Regulation (FAR) Subpart FAR 6.302-5 V. Applicability of Authority: PRO-MED LLC is the only SDVOSB at this time that provides recycling of EP Catheter tips. Authority was granted under amended Title 38 and public law 109-461 to the VA to sole source to Service Disabled Veteran Owned Small Businesses. This contractor has been deemed responsible and is registered in Vet-Biz. VI. Efforts to Obtain Competition: See part IV VII. Fair and Reasonable: The 2004 Consolidated Appropriations Act, Public Law 108-199 allows, all revenue earned by VHA recycling and waste prevention programs is available for VHA use. These funds remain available for obligation until expended. VIII. Market Research This service is not available from a mandatory source, government wholesale supplier, or mandatory or optional supply schedule, GSA, Vet-biz was searched. Market research found one socioeconomic category supplier. Only one responsible source was found. PRO-MED LLC, a Service Disabled Veteran Owned Small Business enterprise.
