Description
Q. Does 100% Small Business set-aside indicate all consultants, prime and sub-consultants must be a Small Businesses? A. For any small business set-aside contract, the Limitations on Subcontracting Clause (FAR 52.219-14) must be included. For this contract the prime must perform at least 50 percent of the cost of contract performance incurred for personnel with its own employees. A small business can certainly use a large business as a subcontractor/teaming partner; however, in a prime to sub relationship, the prime must perform the required percentage of work. In the case of a joint venture (small/large business), then the joint venture (JV) is the prime and must adhere to the clause. The JV must be considered small for the procurement.
