- THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY THIS OPPORTUNITY IS AVAILABLE ONLY TO CONTRACTORS THAT HAVE BEEN AWARDED ENVIRONMENTAL PROTECTION AGENCY (EPA) TARGETED BROWNFIELDS ASSESSMENTS (TBA) CONTRACTS The purpose of this notice to announce the intention to competitively award a Task Order from the Targeted Brownfields Assessments (TBA) Contracts Request For Offer # 38. The period of performance will be from November 1, 2009 though March 26, 2010. This requirement is for contractor performance of a phase I and phase II Environmental Site Assessment. In planning this phase I and II ESA, the contractor shall utilize information from all previously completed workplans, investigations and cleanups, performed by Intermet and their consultants. The phase II ESA shall consider recommendations in the Phase II RFI work plan, address data gaps and, as necessary (based on input from EPA and the Virginia Department of Environmental Quality (VDEQ)), address other areas, including Solid Waste Management Units and Areas of Concern within this 85 acre area for which EPA has obtained access. The general objective of the phase II ESA is to perform all characterization efforts (including collection/analysis of environmental samples, evaluation of results and preparation of a report) necessary to determine the nature/extent groundwater and soil contamination and additional cleanup efforts which may be required by EPA/VDEQ. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Brownfields and Land Revitalization (OBLR) contracts were not awarded as FP contracts, they were awarded competitively, and each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OBLR contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OBLR contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA.
