Description
JUSTIFICATION FOR OTHER THAN FULLAND OPEN COMPETITION 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2. Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract to relocate the pharmacy cache and medical records at the Oscar G. Johnson VA Medical Center 3. A description of supplies/services required: In accordance with the specifications and drawings the contractor shall provide and furnish all labor, superintendence, materials, tools, equipment, transportation, licenses, certificates, insurance, temporary protection, and other items designated under the provisions of this contract Pharmacy Cache and Medical Records Relocation, project number 585-09-120 necessary for construction in B011 for new Medical Records, Pharmacy Cache, Emergency Management, Industrial Hygienist, and telecommunications closet on the basement floor, room B011, of Building 1 of the VA Medical Center Iron Mountain. This project is to be completed within 90 calendar days. 4. Statutory authority permitting other than full and open competition: FAR 6.302-5 FAR 6.302-5 is "Authorized or required by statute." 41 U.S.C. 253(c)(5) allows for other than full and open competition. It is 38 U.S.C. 8127 (P.L. 109-461) that gives VA this authority. 5. Facilities Unique Qualifications: Under the authority of PL 109-461, an SDVOSB firm has been identified by the COTR and CO who is qualified and experienced to perform this work. It is anticipated that a fair and reasonable price will be obtained for this work. Public Law 109-461, Veterans Benefits, Health Care and Information Technology Act of 2006 authorizes sole source procurements to Service Disabled Veteran Owned Small Business. 6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable: N/A - Public Law 109-461 allows sole source procurements to SDVOSB firms. 7. A description of the market research conducted or statement why market research was not conducted: AH West Group, LLC is registered in VetBiz as a SDVOSB firm and therefore is eligible for sole source award in accordance with the requirements in Public Law 109-461. 8. Other facts support the use of other than full and open competition: Public Law 109-461, VA Information Letter 049-07-08. 9. Actions to remove or overcome any barriers to competition: None 10.
