Description
Department of Veterans AffairsNetwork 22 Logistics Office Justification for Other than Full and Open Competition Under Authority of 41 U.S.C. 253(c)(1) and FAR 6.302-1 1.The VA Network 22 Logistics Office, 5901 East 7th Street, Long Beach, CA, on behalf of the VA Loma Linda Healthcare System, Loma Linda, CA, intends to enter into a contract for other than full and open competition. 2.The request is being procured from a specific vendor exclusive of competition. 3.The VA Loma Linda Healthcare System is requesting sole source procurement from Advanced Sterilization Products (ASP), division of Ethicon, Inc., a Johnson & Johnson Company, for the EVOTECH Endoscope Cleaner and Reprocessor (ECR) system. The cost is $248,981.12. 4.The equipment and supplies are being procured under authority of 41 U.S.C. 253(c)(1) and FAR Part 6.302-1. These statutory authorities allow the use of noncompetitive procedures when an agency requires property or services that are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. 5.The requested EVOTECH ECR system is required to clean and disinfect endoscopes. It is the only system cleared by the Food and Drug Administration (FDA) that fully automates both the cleaning and reprocessing of endoscopes. It establishes a high level of cleaning and disinfecting while eliminating labor-intensive and time-consuming manual brushing. In addition, the system automatically detects leaks and tests the cleaning solution's minimum effective concentration. Healthcare staff can therefore have complete confidence that endoscope cleaning is safe and consistent, freeing them to focus on patient care. ASP is the only manufacturer and distributor of this system; no other company is authorized to sell the EVOTECH ECR System in the United States. Because of increased safety and timeliness of patient care, procuring this equipment has been determined to be in the best interest of the Government and patient welfare. 6.A presolicitation announcement stating the intent to procure the EVOTECH ECR System on a sole source basis will be posted to FedBizOpps in accordance with FAR 5.201. 7.Since this procurement involves no price competition, a determination of fair and reasonable cost was made by comparing the present quotation with a recent procurement for the same equipment. As part of solicitation VA-798-09-RQ-0019, Brian Johnson, VA Contracting Officer at the Center for Acquisition Innovation in Frederick, MD, prepared a detailed cost analysis dated 5/20/2009 (attached). Elements of his analysis are directly applicable to this procurement. Based on this comparison, the anticipated cost was determined to be fair and reasonable to the Government. 8.Market research was conducted via the internet and email. The internet search identified no other sources for the stated requirements. The search did find a link to a 4/22/09 sole source procurement notice for this equipment posted on FedBizOpps by Brian Johnson, VA contracting officer in Frederick, MD (attached). Brian was contacted to review his process for sole source justification; his response is attached. To ensure that ASP remained the sole source provider to date, a search of FDA records was conducted. This search yielded no other source for an FDA-cleared fully automated endoscope cleaner and reprocessor. A presolicitation announcement will be posted to FedBizOpps in accordance with FAR 5.201. 9.There are no additional facts supporting the use of other than full and open competition other than those stated in paragraph 8 above. 10.No other sources are expected to respond to the presolicitation announcement that will be posted on FedBizOpps. 11.Prior to future procurements for these items/services, market research will be conducted to determine if sole source procurement is justified. The procurement will also be publicized in accordance with FAR Part 5 in an attempt to identify additional sources. If additional sources are identified, the procurement will be completed in accordance with FAR Part 6. 12.This justification is accurate and complete to the best of my knowledge and belief.
