Description
As shown below please find the following contractor question (Q) and subsequent government answers (A) regarding the Courier Services for WTXVAHCS and surrounding CBOCs under solicitation VA-258-09-RP-0202: Q1: Para 7 d. Since the Service Contract Act applies to this contract, FAR 22.1003-1 appears to require that SDVOSB prime contractors perform these services with employee drivers paid IAW the SCA as opposed to using independent contract drivers (paid by the mile or similar) is that a correct interpretation? FAR 22.1003-1 also appears to state that the SCA wage requirement applies to any subcontractors or subs to those subcontractors used on this contract is that a correct interpretation? If this is correct, are prospective bidders required to include a statement to the effect that they and their subs are using employees and that all are paid in compliance with the SCA in the pricing portion of their proposals? [Reference] FAR 22.1003-1 General. [Excerpt from FAR Subpart 22.10 Service Contract Act of 1965, as Amended] This Subpart 22.10 applies to all Government contracts, the principal purpose of which is to furnish services in the United States through the use of service employees, except as exempted in 22.1003-3 and 22.1003-4 of this section, or any subcontract at any tier there under. This subpart does not apply to individual contract requirements for services in contracts not having as their principal purpose the furnishing of services. The nomenclature, type, or particular form of contract used by contracting agencies is not determinative of coverage. A1: Ultimately to ensure that the SCA is followed and hourly payments to any subcontractors, however managed by the prime, at least meet the minimum if not exceed as per the wage determination applied and/or used. No certification is required because each perspective offeror self-certifies via their signature upon the SF1449.
