Description
Justification for sole source award SUBJECT: NOTICE OF INTENT TO AWARD A SOLE SOURCE PROCUREMENT FOR UNINTERRUPTED POWER SUPPLY (UPS) BATTERIES. DESC: INTENT TO AWARD A SOLE COURCE, FIRM FIXED PRICE PROCUREMENT WITH Weber & Associates, Inc. The Air Force, McConnell Air Force base, KS intends to award a Sole Source purchase order under Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items and FAR Part 13, Simplified Acquisition Procedures to Weber & Associates, Inc, 1427 E Waterman, Wichita, KS, 67211. The Sole Source purchase will be for the following: one (1) Liebert CW026DCSA3 Precision Cooling System and installation. Description: The requirement consists installing chilled water piping, pipe insulation, and electrical wiring to support one (1) Liebert CW026DCSA3, 460 Volts, 60Hz, 3 Phase Precision Cooling System. Weber & Associates, Inc is the only known source that can satisfy the requirement of the Government at this time. See attached justification for further information. Please note this is not a request for competitive proposals. However, all interested parties who believe they can meet the requirements are invited to submit in writing complete information describing their ability to provide the UPS Precision Cooling System. Fax Number: 316-759-5634. Information received as a result of this notice will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Air Force not to open the requirement to open competition, based on response to this notice, is solely within the discretion of the Air Force. If the office has not received any affirmative written responses by Close of Business (COB), 14 September, 2009, a Sole Source, firm-fixed price contract will be pursued with Weber & Associates, Inc. 5352.201-9101 OMBUDSMAN (10 AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMBC A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Mr. Michael R. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
