Description
LIMITED SOURCE JUSTIFICATION In accordance with FAR 8.405-6 (g) the following limited source justification is provided for the purchase of a Sonet (Synchronous Optical Network) Ring and telecommunication services through the period 09/30/2010, with one additional Option Year for the period 10/01/2010 through 09/30/2011. i. Contracting Activity U.S. Department of Veteran Affairs Office of Acquisition, Logistics, Management, and Construction Center for Acquisition Innovation - Austin (CAI-A) 1615 Woodward, Austin, TX 78772 ii. Nature and Description of Action: The Department of Veterans Affairs anticipates a sole source award to AT&T off of their GSA Schedule for firm fixed price services. iii. Description of Supplies and Services: The Department of Veterans Affairs, Center for Acquisition Innovation - Austin (CAI-A) plans to contract with: AT&T 208 S. Akard StreetRoom 320Dallas, TX 75202 The requirement is for an additional Sonet (Synchronous Optical Network) Ring from the Local Exchange Carrier with the same routing configuration as the present 8V242 SONET Ring. The slot configuration will be for four OC-12 circuits. Two non-recurring charges are related to the Sonet Ring, including an ORCMX MSA Administrative Charge; and a NRMCK MSA Design and CO Connection charge. In addition the monthly telecommunication service charges include the following: LINE ITEMQTY1. FP5EX MSA NODE - OC-48 - CUSTOMER PREM - FIRST1 2. FC5EX MSA NODE - OC-48 - CENTRAL OFFICE2 3. SPRHX MSA PORT - OC-12 AT OC-48 NODE8 4. 1YAZX MSA MILEAGE - OC-48 - PER MILE7 iv. Identified of the Justification Rationale: FAR 8.405-6 (b) (1). AT&T installed the trenches and laid the cabling and fiber to perform install Sonet Rings and perform the monthly service, and therefore are the sole provider in Austin, TX. Other carriers would be required to dig trenches through streets, parking lots, and road to lay the required cable and fiber prior to being able to quote for this requirement. This would cause an additional cost to both the contractor and VA. In addition, the Austin Municipal local government would need to approve the new vendor as well as GSA in order to perform these services. AT&T is the only Local Exchange Carrier. v. Determination by the Ordering Activity Contracting Officer Consistent with 8.404(d): GSA has already determined the prices of fixed prices services under schedule contracts to be fair and reasonable. In addition, prices for the Sonet Ring and monthly services will be consistent with standard commercial rates. This will ensure that the price is fair and reasonable, and the total price is in the best interest of the Government. The independent Government cost estimate is based on this commercial rate. vi. Market Research. The program office, and other contracting officers have contacted other carriers, such as Verizon, in order to determine if the requirement is sole source. Other carriers have confirmed verbally that AT&T is the Local Exchange Carrier, and the only provider of this requirement. vii. Other Support Facts:n/a viii. Overcoming Barriers to Competition: Future requirements could be combined in order to perform a competitive procurement so that all carriers can provide a quote so that the cost of laying cable and fiber is cost effective. However, while AT&T is the only Local Exchange Carrier with the infrastructure in place to provide a Sonet ring with monthly services, AT&T will be the only provider. Responses to this notice must be in writing and must be received Friday, September 18, 2009 4:30pm CST. Third part firms will be considered only if responding with clear and convincing evidence that the firm has been granted rights to provide the services being procured. The determination to open competition based on responses is solely with in the discretion of the Government. If a solicitation is issued, no additional synopsis will be published.
