Department of Veterans AffairsVISN 16Justification for Other than Full and Open Competition 1. Identification of Agency and Contracting Activity. Department of Veterans Affairs, Alexandria VA Medical Center, Purchasing and Contracts, 2495 Shreveport Highway 71 N, Pineville, LA 71360, proposes to enter into a contract on a basis other than full and open competition for Blood, Blood Products and Related Services. 2. Nature/Description of Action. a. This action is a follow-on procurement for services, in support of the Alexandria and Shreveport VA Medical Centers, from LifeShare Blood Centers, 8910 Linwood Ave, P.O. Box 65270, Shreveport, LA 71136 for the period 01 Oct 09 through 30 Sep 10 and 4 one-year options. b. The contract award type will be a requirements contract except for fresh frozen plasma (FFP), which is included as an emergency backup requirement for the VISN contract. c. IAW FAR 13.500, Test Program for Certain Commercial Items, this streamlined acquisition will be issued as a request for quote under FAR Part 12 and 13. 3. Description of Supplies/Services. a. Blood, blood products and related services are needed by the medical centers in the operations of their facilities. This procurement is to supply these items to the centers in accordance with standards set by the Food and Drug Administration (FDA), American Association of Blood Banks, and the College of American Pathologist. b. Blood is a perishable commodity and quality standards must be maintained to preserve human life. While the donated blood is free, there are significant costs associated with collecting, testing, preparing components, labeling, storing and shipping blood, recruiting and educating donors, and quality assurance. Deliver of blood and blood products is time sensitive. For this requirement, delivery must be made with as little as two hours advance notice of Shreveport and four hours for Alexandria. Pickup of samples for testing may be required within 30 minutes in time of acute emergency. Estimated Value: Annual estimated cost for Shreveport is $606,353.00 Annual estimated cost for Alexandria is $265,370.00 Total annual estimated costs is $871,723.00 Total estimated value of base and four one-year options is $4,358,615.00 4. Identification of Statutory Authority. Rationale in support of citation in Paragraph 4 above. a. This acquisition is being procured on a sole source basis due to LifeShare, a nonprofit organization, is the only source with the organization structure to meet the mandatory delivery requirements of this contract. LifeShare has been providing blood and blood products to the VA Medical Center for more than 18 years without problems. They have proven reliability to fulfill the stringent requirements to provide this service. b. LifeShare can deliver products and services which meet standards established by the AABB, CAP, FDA, Joint Commission, and other accrediting agencies. They are licensed by FDA for collection, processing and distribution of blood and blood products and services. Their testing methods and equipment are approved and they have trained personal performing the test(s). c. The above acquisition will be negotiated with a representative of LifeShare. The current LifeShare representative with the VA is Norbert Craft. Signature authority for the Contractor will be Linda N. Allsap, Executive VP, Chief Financial Officer. 6. Determination of a Fair and Reasonable Cost. a. The Contracting Officer determines that the anticipated price will be fair and reasonable based on LifeShare's published price list for full service hospitals. The IGE is in accordance with the June 2009 price list. Pricing is evaluated and determined each June by the Board of Trustees in accordance with the past year's expenses and income. Testing is the primary cost area with extensive testing required for communicable diseases(s) and the quality assurance monitoring system required. There is no charge for the actual blood, it is all donor blood. Recruitment costs are the only direct expenses involved. The contract options will be set up and evaluated with the base year's prices and the cost of the blood services will be adjusted yearly when the non-profit publishes the next year's costs in June. 7. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. A review of blood banks, (who do business with the Government) servicing the Louisiana area was made. The only other blood bank identified, services the New Orleans and Southern Louisiana area. No other blood banks have been identified in the past or present who can perform these services in accordance with the requirements of the Statement of Work. 8. Additional Support for the use of other than full and open competition. a. The statement of work has stringent requirements due to the nature of the commodity. The quality standards for collecting, testing, preparing components, labeling, storing and shipping blood, recruiting and educating donors, and quality assurance cannot be waived. Blood banks must be registered with the Food and Drug Administration (FDA) and provide services in accordance with standards established by recognized accrediting agencies such as the American Association of Blood Banks, the Food and Drug Administration and the College of American Pathologist. Delivery times of the blood are established to preserve human life. All these requirements limit the pool of potential sources and cannot be waived. 9. Sources expressing an interest. No other sources have express interest in this requirement. 10. Actions, if any, being taken to remove barriers to full and open competition. A sources sought was issued in FedBizOpps on 21 Jul 09 with a closing date of 31 Jul 09. There were no respondents for this requirement. LifeShare has expressed verbally interest in continuing services with the VA Medical Centers. 11. Delivery Requirements. Delivery of products and services must be reliable and timely for both delivery and emergent needs that may arise at any time. Therefore, these services must be available 24 hours per day, seven days per week regardless of holidays to ensure an adequate blood supply at all times. These services are directly related to patient health and welfare. 12. Acquisition Plan. An Acquisition Plan (X) is ( ) is not required for this acquisition. 13. IT Approval.
