DEPARTMENT OF VETERANS AFFAIRSLOUIS STOKES CLEVELAND MEDICAL CENTERVISN 1010000 Brecksville RoadBrecksville, OH 44141-3204 JUSTIFICATION AND APPROVAL TO PROCUREUSING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of FAR 6.302-2. JUSTIFICATION 1.Identification of Agency and Contracting Activity. The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10000 Brecksville Road, Brecksville, OH 44141-3204, VISN 10 contracting Activity. 2.Nature/Description of Action. This activity proposes to procure an undefinitized purchase order with the Laboratory Corporation of America for one month of third party diagnostic laboratory testing under decentralized authority to the Pathology and Laboratory Management Service. This procurement provides a temporary solution to ensure continued critical diagnostic testing services until a new contract can be awarded. The period of performance is September 1, 2009 to September 30, 2009. 3.Description of Supplies/Services. This requirement is to allow the Cleveland VAMC's Pathology & Laboratory Management Services to maintain the level of patient care services required by the Medical Center's Quality Assurance Management. The Cleveland VA Medical Center does not have the capacity, personnel, expertise or funding to conduct the advanced diagnostic testing to treat our veteran population. Advance specialized testing services provided by a third party vendor are critical to maintaining an effective Pathology and Laboratory Management Services, as well as, the clinical operation of the medical center. Without third party diagnostic testing services, the clinical staff will not be able to properly diagnose and treat veterans at the medical center. The estimated per month cost is not to expected to exceed $45,000.00. 4.Identification of Statutory Authority. The statutory authority permitting URGENT AND COMPELLING procurement is FAR 6.302-2. 5.Rationale in support of citation in Paragraph 4 above: Description of contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: Laboratory Corporation of America was the provider of these services under a payment plan using VA form 1358. This service is necessary to perform testing, diagnosis, treatment and data analysis in the Laboratory and Medical Services. The services are necessary to provide quality service for veterans at the VA Medical Center. The service is for direct patient care. Without accurate and timely test results, patient care is significantly compromised. The departments must have the flexibility to outsource tests during times of extreme workload or when the costs of space requirements for a particular test makes performing the test on station impractical or physically impossible. This presents an urgent and compelling need to continue these services with the only known vendor while a formal solicitation is ongoing. Failure to procure diagnostic testing services for the hospital would threaten the health of well being of veterans-patients. 6. Federal Business Opportunities (Fedbizzops) Announcement/Potential Sources. This requirement will not be synopsized in accordance with FAR 5.202(a)(2). 7. Determination of a Fair and Reasonable Cost The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on price analysis of previous purchases 541-C90436 $45000.00. 8. Description of market survey. Initial market research has determined that the VA's has utilized only the incumbent vendor in the past few years. 9. Additional Support for the use of other than full and open competition: None. 10. Sources expressing an interest: None. 11. Barriers to full and open competition: This is a temporary procurement to continue performance of a vendor during a new solicitation for the same service.
