- THIS IS A COMBINED SYNOPSIS/SOLICITATION for commercial items, prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. SPM4A8-09-X-0075 is hereby issued as a sole source solicitation for the procurement of a Kellerin Bridge Crane Kit, model KEL-T5-21.8-DC/AC. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This is notice of the Government's intent to restrict this procurement to a sole source: Elliott-Lewis Corp. (CAGE 81135), under the authority of 10 U.S.C. 2304(c) (1) as implemented by FAR 6.302-1, Only one or a limited number of responsible sources, and no other supplies or services will satisfy agency requirements. The agency's minimum needs can only be satisfied by the unique supplies or services available from limited sources, which possess unique capabilities demonstrated as follows: 1. The design of this bridge crane kit is proprietary to Kellerin. There are multiple Kellerin systems already installed at NNSY and this procurement is an upgrade to the existing machines. Continuity of operations is critical as the machine shop fabricatescomponents that support shipyard production in the repair of the Navy Fleet. 2. Elliott-Lewis Corp. as the authorized distributor of Kellerin model KEL-T5-21.8-DC/AC installed the original units and is the only company with the knowledge, experience and expertise to perform the required upgrade. 3. Use of any other vendor will undermine NNSY compliance with NAVSEA guidance to standardize equipment and maintain configuration control in the Shipyard's crane inventory. The contractor identified above is the only known source that can meet all of the requirements. This is not a "full and open" competitive solicitation, and quotes are not being requested from vendors other than Elliott-Lewis Corp. Any other responsible source capable of meeting the requirement may submit technical, delivery, pricing, and past performance data sufficient to determine capability for future purchases. All vendors must be registered in the Central Contractor Registration (CCR), ORCA, and have a valid DUNS number, Cage Code, and Tax Identification Number. The award will be made as a firm fixed price contract. The required performance period is 60 calendar days or sooner after receipt of contract. QAP 215 applies. Line 0001: KEL-T5-21.8-DC/AC,KELLERING BRIDGE CRANE KIT, Qty = 1 EACH Line 0002: Shipping to Portsmouth, VA, Qty = 1 • Supplies & services shall be in accordance with Purchase Description DCSR-FAPBB-08-14-1500 dated April 1, 2009, available from the buyer upon request. Vendor is required to submit complete descriptive literature supporting compliance with the PD. The equipment shall be new and unused, capable of performing its intended function in accordance with the operation of the original equipment combined with the upgraded specifications. • FOB is Destination. Inspection at Origin and Acceptance at Destination. • Socio-economics Programs: unrestricted. • The solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular. • The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. • Offerors must include a completed copy of the provision 52.212-3, Offeror Representations and Certifications-Commercial Items, with the offer. • The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. • The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes of Executive Orders-Commercial Items, applies to this acquisition, including: 52.222-50 ALT 1, 52.203-6, 52.219-14, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-39, 52.225-13, 52.232-30, 52.232-33, and 52.247-64. • Per DFARS Clause 252.232-7009, Electronic Submission of Payment Request, contractors must submit invoices electronically via the WIDE AREA WORK FLOW (WAWF) online at https://WAWF.EB.MIL.
