Description
This contract action was accomplished using other than competitive procedures because this is a task/delivery order where an exception to fair opportunity requirements was approved as this is a follow-on order to a competitive initial order (FAR 8.405-6(b)(2) or 16.505(b)(2)(iii). CENWK-PM-MM10 July 2009 SCOPE OF WORK WASTE WATER TREATMENT PLANT DIGESTER LID REPAIR DESIGN ARRA P2 324872 FORT LEONARD WOOD, MISSOURI 1. General Project Description: This project involves preparation of design documents for removal of the Sewage Sludge Digester Lids and Conversion of the Digesters from anaerobic digestion to aerobic digestion at Fort Leonard Wood, MO. Project will constitute all of the work involved in design for the removal of the digester lids by a competent contractor with the necessary equipment, mechanical, and electrical work necessary to convert the digesters to aerobic sludge digestion. If the preceding criteria do not cover specific conditions related to the design, the Architect-Engineer (AE) shall contact Corps Project Manager (PM) before proceeding. If there is a conflict in design instructions or other reference data, such questions or conflicts should be brought to the attention of the Corps PM before proceeding. Design work includes preparation of plans, specifications, Design Analysis Report, detailed construction cost estimates, and subsurface investigation. Formal design submittals are required at 50%, 95%, and 100%. The AE will comply with all current force protection guidelines and standards contained in UFC 4-010-01, Minimum DoD Antiterrorism Standards for Buildings. 2. Architect-Engineer Services: Task 1: Kick off Meeting: A design teleconference kick-off meeting shall be conducted to ensure all parties are aware of and understand all components of this project. Task 2: Investigations: The AE shall confirm the survey data developed during design of the WWTP addition is sufficient for the work to be accomplished and verify that it is complete for the area to be developed as part of this project. If any additional survey data is required, the AE shall provide the survey necessary for completion of the project. A document including Kansas City District technical requirements for surveys is included in Attachment 1. Confirm results of geotechnical investigation developed during the investigation for the development of the design for the WWTP to ensure sufficient information is available to provide appropriate support for installation of any new equipment. The final subsurface Investigation Report will become part of the Design Analysis. Format for Geotechnical Investigations are included in Attachment 2. Task 3: 50% Design Package: The 50% design submittal will consist of a design analysis, calculations, drawings, and the Unified Facilities Guidance Specifications (UFGS) sections to be included in the final design. The Dr. Checks internet-based review comment program will be utilized. The 50% Design submittal shall, as a minimum, include the following: a. Drawings: i. Current Conditions Plan (show what is to be removed/demolished) ii. Project site and floor plans iii. Area site plans detailing where modifications to existing connections or locations of new connections to existing sewage treatment plant systems will be made iv. Aerobic Digester details and sections v. Mechanical, electrical, and information systems at 50% design complete vii. Other plans as deemed necessary to present the design in a clear and accurate way b. Draft guide specification sections proposed for inclusion in the final design and a minimum of 50% of the specifications (including fill-in portions) completed prepared in SPECSINTACT. c. Design Analysis Report d.Construction cost estimate. Cost estimate shall be submitted under separate cover to the Corps Project Manager (3 copies) e.Quality control documentation. A 50% review conference will be conducted at Fort Leonard Wood to address comments on the 50% design package and provide additional input regarding direction of the design. The AE shall furnish one person from each major discipline involved in the design and the Project Manager to attend. Task 3: 95% Design: The Pre-final Submittal (95% design package) incorporates all satisfactorily addressed and closed review comments, and includes: i. Completed drawings. ii. Completed Specifications. iii. Updated design analysis, including a Dr. Checks printout of the final review comments, responses, and comment closures). iv. Construction cost estimate. Cost estimate shall be submitted under separate cover to the Corps Project Manager (3 copies) v. Draft submittal register. vi. Quality control documentation. A 95% design review conference will be held via conference call. The AE shall furnish one person from each major discipline involved in the design and the Project Manager to attend. Task 4: 100% Design: The final 100% design submission provides project documents that are ready for advertisement, corrected to reflect final review comments. The AE shall furnish: vi. Signed and sealed original plans. Hard and electronic copies per distribution list vii. Updated specifications viii. Updated design analysis, including a Dr. Checks printout of the final review comments (95% submittal comments, answers and comment closures). ix. Updated construction cost estimate. Cost estimate shall be submitted under separate cover, only to the Corps Project Manager (3 hard copies) x.Updated submittal register. vi. Final quality control documentation. c. Back-check Submittal. On completion of the back-check review by the district to ensure that all approved comments have been incorporated, the A-E shall provide the complete set of electronic files for the plans, specifications, cost estimate and submittal register (source files and.pdf files shall be provided for all submittals). The files required for electronic bidding shall be provided on a separate CD from the other files. Task 5: (Optional): Services During Construction. To be negotiated and addressed under a modification to this task order as determined at a later time. 3.Authorization: This project was authorized by Fort Leonard Wood sent via e-mail dated 11 June 2009. 4.Cost Limitation: The construction cost shall not exceed $ 1.7 million. 5.Coordination of Plans and Specifications: The importance of careful checking and coordination of plans, specifications and other project documents cannot be overemphasized. It shall be the responsibility of the AE to check and coordinate all project data prior to all submittals. Deficiencies, ambiguities, conflicts and inconsistencies shall be rectified prior to submittal of documents. The letter of transmittal shall certify that all documents have been checked and coordinated prior to submittal and shall be signed by a principal of the AE firm. 6.Release of Information: The A-E shall not publicize nor release in any manner information or data in regards to projects on which it is working or negotiating with this office, nor discuss prior to public release by this office, a project, any future program, or any planning with anyone not directly concerned with the design of the project. Any inquiries in regard to these matters shall be referred to the Contracting Officer or District Project Manager. Classified information obtained from this office shall be treated in accordance with instructions in regard to such matters. 7.Quality Control Plan: A Quality Control Plan specifically tailored to this project shall be prepared and submitted for approval by the Contracting Officer within 30 calendar days of Delivery Order award. The QCP shall describe methods, tests, procedures, inspections, documentation, and other information as necessary to provide complete assurance to the Government that work will be conducted in accordance with acceptable standards of engineering and scientific practice. The plan shall describe the quality control organization with named individuals, qualifications of those individuals, responsibilities, and chains of authorities. It shall describe internal quality control reporting procedures and those for quality control reporting to the Government. Function-specific quality control checklists used for review of documents must be included in the QC plan. These completed checklists must be provided along with a certification of compliance with the Quality Control Plan as part of each submittal. Failure to provide adequate quality control processes or failure to comply with an approved Quality Control Plan may form the basis for withholding payment or requiring corrective actions at no additional cost to the Government. Inadequate quality control may also result in an unsatisfactory performance rating. A certification similar to 'This product was completed and reviewed in accordance with Our Company's Quality Control Plan. It is believed to be in compliance with all applicable criteria and this contract's scope of work.' shall be included as part of each submittal. 8.Deliverables: * Quality Control Plan 28 August 2009 * 50% Design Package 04 September 2009 * 95% Design Package 25 September 2009 * 100% Backcheck Design Package05 October 2009 * Sealed and signed Final Design (100%) Package15 October 2009 * CADD files, all source files 9.Anticipated Design Schedule: Objectives: Award the Delivery Order by 14 August 2009 and sealed and signed Final Design (100%) Package no later than 15 October 2009. a.Kickoff Meeting via teleconference within 1 week after receipt of Notice to Proceed b.Quality Control Plan shall be submitted within 2 weeks of receipt of Notice to Proceed. c.50% Design package shall be provided by the AE within 21 calendar days of receipt of Notice to Proceed. d.95% Design package shall be provided by the AE within 21 Calendar days of the 50% review conference. e.100% Design package shall be provided by the AE within 10 Calendar days of the 95% review conference. f.Advertise for Construction 1 November 2009 10.Submittal Requirements: a. Miscellaneous. All submittals are to be sent by express mail or other expeditious means. Distribution of each design submittal will be made by the AE directly to the reviewing agencies in accordance with the Distribution List Attachment 3. b. A letter of transmittal identifying the submission and listing material being submitted shall accompany each submission. The letter shall be referenced to the project by title, number and location. c. Partial submittals will not be accepted. d. Detailed cost estimates will be submitted only to the Corps PM. 11. Drawings. All drawings shall be prepared in accordance with the Kansas City District AE Manual as well as the Tri-Service A/E/C CADD Standards and KCD Standards. Design criteria and referenced drawings furnished by the Government are intended to serve as a minimum standard for the AE in the preparation of acceptable working drawings and specifications. Applicable details of these drawings shall be incorporated into the working drawings and specifications without reference to their source. Incorporation by reference only is not acceptable. The AE shall be responsible for the preparing drawings that are fully compatible with MicroStation V8 or higher. This system operates using a Windows NT operating system. Save all design CADD files as MicroStation V8 or higher files. The AE shall be responsible for all translations to 100% compatibility. This includes, but is not limited to placement of graphic elements on specified levels producing lines with specified weights, colors, and styles. Additionally the system shall be capable of using multiple reference files as overlays to the active file. The Government will only accept the final product for full operation on the target system. All finished drawings shall be delivered in both hard copy and CD. In addition to the native CAD design files, provide separate electronic drawing files (in editable CAD format and Adobe Acrobat PDF version 7.0 or higher) for each project drawing. Each file (both CADD and PDF) shall represent one complete drawing from the drawing set, including the date, submittal phase, and border. Each drawing file shall be completely independent of any data in any other file, including fonts and shapes not included with the basic CADD software program utilized. Drawing files with external references or special fonts are not acceptable. All displayed graphic elements on all levels of the drawing files shall be part of the project drawing image. The drawing files shall not contain any graphic element that is not part of the drawing image. CADD/GIS requirements: Drawing files shall comply with comply with the requirements of Engineering & Construction Bulletin No. 2006-15 'Standardizing Computer Aided Design (CAD) and Geographic Information Systems (GIS) Deliverables for all Military Design and Construction Projects,' dated 26 December 2006 Updated November 2008 Attachment 4. 12. Specifications. i. The A-E shall prepare specifications using Unified Facilities Guide Specifications in SPECSINTACT. If the AE needs to prepare specifications for items of work not covered by guide specifications, the format of the new specifications shall match the guide specifications. ii. Only those Federal and Military specifications and standards that have been approved or waived for use shall be included in the specifications. The list of approved or waived specifications and standards is available at the TECHINFO web site. iii. If a Corps of Engineers Guide Specification is changed, or doesn't exist, the A-E must verify and list in the design analysis a minimum of two, but preferably three manufacturers that meet the final specifications. iv. This project will be advertised using Electronic Bid Set (EBS) on CD. The AE shall, in addition to providing the electronic SPECSINTACT files, translate and provide the specifications in a PORTABLE DOCUMENT FORMAT (PDF). These files shall be the electronic duplicates of the final hard copy submittal. The AE shall coordinate the for the submittal of all specifications prior to plan review with the Corps PM. v. The PDF files shall be fully functional when delivered with no editing required by the Government. 13. Design Analysis. The design analysis shall be prepared in accordance with the guidance provided in ER 1110-345-700. The final design analysis will be updated and revised to reflect review comments and development of the final design. 14. Submittal Register. The AE shall complete the submittal register using SPECSINTACT. The paragraph number referenced in the submittal register shall be where the technical requirements for the submittal are defined, not the paragraph in Part 1 of the specification requiring the submittal. The submittal register must also be provided in a.PDF format for inclusion with the specifications as part of the electronic bid set. 15. Cost Estimates: Cost estimates shall be prepared in DD Form 1391 format in accordance with the Kansas City District Design Manual and relevant Technical Manuals. Cost estimates must break down the costs between the primary construction for the addition to the Waste Water Treatment Plant and the construction to convert the Primary and Secondary Digesters from anaerobic to aerobic conditions. 16.General Requirements and Standards: a. OSHA Regulations. The AE shall be responsible for full compliance with regulations of the Occupational Safety and Health Act of 1970 and for the design of the project to preclude violations to said act from occurring as a result of the design. If at any time during the design phases it becomes apparent that a violation may exist as a result of the design, the AE shall notify the Contracting Officer in writing requesting consultation to resolve the possible violation. b. Site Inspection. The AE is responsible for making the necessary field visits to assess existing conditions and to obtain such detail information as is required to complete the design. Investigations to determine existing conditions and requirements include required permits, such as the National Pollutant Discharge Elimination System (NPDES) storm water permit required by state or local agencies. c. Dr. Checks: Dr. Checks is a web-based system for management of project reviews and review comments. Dr. Checks will be utilized by the AE and the Government to make and manage review comments. AE is responsible for bringing copies of Dr. Checks comments to the review conferences held at Ft. Leonard Wood, MO (Assume 15 sets of copies). The Government will setup the project for using Dr. Checks to manage the review and assist the AE in obtaining access passwords. The AE may receive questions or review comments from the customer or Project Manager that are not in Dr. Checks: AE shall be responsible for providing responses to comments and maintaining necessary documentation for the management of all reviews accomplished under this contract. Design Reviews by the Government are primarily to verify that the final design conforms to design criteria, not technical verification of the design. Where possible, obvious errors and omissions will be noted and brought to the AE's attention. The Government does not assume any responsibility either explicitly or implied for the technical adequacy of the design documents. The Government never 'approves' the design. Additional information about the program and how it is used can be found at Dr. Check web address: http://65.204.17.188/projnet/home/version1/index.cfm. d. Meeting Notes. The AE will be responsible for taking notes and preparing the Meeting Notes for all meetings and conferences, including telephone meetings. Conference, meeting or telephone conversation notes shall be transmitted to meeting participants by e-mail within 5 days after date of the meeting or conference. Format to depend on the formality of the meeting or conversation. Simple e-mails to document informal telephone conversations are acceptable. Meeting notes shall include the date, place and a list of attendees and their organization. e. Review conferences: The AE shall be represented by personnel familiar with the work submitted. Comments made during the conference, or decisions affecting criteria changes, must be recorded in the conference notes. Any augmentation of review comments shall be documented in the conference notes. Written comments presented by attendees shall be attached to each report with the conference action noted. Conference action shall be 'A' for an approved comment, 'D' for a disapproved comment, 'W' for a comment that has been withdrawn, and 'E' for a comment that has an exception noted. Note comments not incorporated and provide a brief explanation for rejection. For comments that required additional checking to resolve subsequent to the review meeting, the final resolution of the comments shall be included in the meeting minutes. The meeting minutes shall also incorporate the comments in DrChecks by reference. f. Site Survey. Confirmation of topographic survey data are the responsibility of the AE. The control points for survey information are contained in the design of the addition to the Waste Water Treatment Plant. It will be the AE's responsibility to tie the design into these control points located at the project site. If the topographic survey data available is not sufficient to cover the area intended for development, the AE shall provide the additional survey data required for completion of this design. g. Subsurface Investigation. Confirmation of borings and field log information are the responsibility of the AE. The foundation analysis and foundation recommendations shall be done by the AE. The Subsurface Investigation Report shall be included in the design analysis. Boring logs and basic soils design assumptions shall be placed on the drawings. Kansas City District guidelines for preparation of geotechnical investigations shall be followed. h. Maps. Topography (including site features), limits of construction and existing utility lines must be adequately described by means of maps. Scale of maps will vary depending on size of the site and intricacy of detail to be shown. In general, maps should be drawn at a scale of not less than 1 inch equals 100 feet. All features will be shown accurately to scale. i.Utility maps will show all utility easements or rights-of-way, location, size and invert elevations of existing sanitary sewers, storm drains or open drainage channels, drain inlets and manholes, location and size of existing water, gas and steam mains and underground conduits, location of existing overhead electric power, street lighting, and telephone lines, including pole locations, location of rail lines and rights-of-way, location of fire alarm call boxes and similar appurtenances. j. Verification of As-Builts. The AE shall be responsible for verifying as-built information as needed for completion of the design. k. Environmental Recommendations. The intent of the Government is to design within environmental requirements currently in effect. Every effort will be made to comply with the environmental recommendations provided by the Installation. If in the opinion of the AE compliance with the requirements cannot be accomplished due to engineering problems, the AE will immediately notify the Contracting Officer in writing with recommendations. l. Project Manager. The AE shall assign a principal or key employee to serve as the Project Manager. The Project Manager shall oversee the coordination of the entire project effort and shall be capable of administering all instructions and obtaining answers to all questions during and after the design work. During the prosecution of the work under the contract, the AE's PM shall keep in close liaison with the District PM, who will coordinate the work with the Using Service and other agencies. All requests made by the Using Service and other agencies shall be referred to the PM. At appropriate times, representatives of the Contracting Officer may review the progress and technical adequacy of the work, including adherence to the approved QCP. Such review will not relieve the AE from performing all contract requirements, except as may be waived by written instruction. AE shall notify the District in writing prior to changing Project Managers. The Project Manager shall have at least 10 years of progressively responsible experience and be either a Registered Professional Engineer or Registered Architect in the State of Missouri. m. Bidding Procedures. Reproduction of CDs containing the plans and specifications for bidding purposes will be accomplished by the Government. The Government will also issue all documents to prospective bidders and will receive all bids. During the bidding period when plans and specifications are out for bids, the AE shall not give out any interpretations or provide any responses regarding any inquiries from prospective bidders. All inquiries from prospective bidders, whether oral or written, shall be forwarded to the District PM. The Government will evaluate all bids; however, the AE shall render such assistance in the bid evaluation process as may be required by the Contracting Officer. The Government will modify the AE's task order if it is determined that bid evaluation assistance is required. The AE may be required to provide amendment documents to the government for issuance during advertisement. If the correction required is a result of an error or omission of the AE, the revised amendment documents shall be provided at no additional cost to the government. If the amendment changes are as a result of changed criteria or other similar circumstances, an appropriate modification to the AE's contract will be done. n. Posting Amendments to Drawings. The AE shall revise the original CADD files on completion of advertisement and provide the files to the district. The AE shall revise the files within three (3) calendar days following notification of the government to do so by posting all amendments and adding the contract and amendment numbers. Extreme care shall be exercised to ensure that only the exact drawing revisions contained in the solicitation amendments are posted. No other changes or clarifications are to be made. The updated files shall be returned to the district project manager. Correction of these files shall be at no additional cost to the government if the changes were required as a result of AE errors or omissions in the project documents. If the amendment changes are as a result of changed criteria or other similar circumstances, an appropriate modification to the AE's contract will be done. 19. Services During Construction (Task 5 - Optional). Upon receipt of a modification exercising this option(s), the AE shall proceed with some or all of the following work and services as specified in the modification. These tasks will be negotiated at the time the option is to be executed: a. Checking of Shop Drawings. Check and recommend approval, or disapproval, of all shop and working drawings, including catalog cuts, diagrams, samples, required for the selection of material and/or colors, and other descriptive data, submitted by the Construction Contractor pursuant to the technical provisions of the contract specifications. b. Design During Construction (DDC). Perform necessary design services during construction including: visits to the site, preparation of modifications to the plans and specifications for user-requested changes and changed field conditions, necessary estimates for budgeting possible changes and for funding and negotiating the contract changes. Provide design services for questions that arise during construction that are not covered by previously contracted design services. Serve on safety investigation or value engineering teams as may be required. Appropriate documentation of DDC expenditures will be required by the District prior to approval of payment. c. A representative of the AE's office shall make site visits during construction as requested by the government. The AE shall coordinate with the Corps of Engineers Area Office in advance of their visit and provide assistance to the Area Office for questions or clarifications that arise during construction. The AE shall respond to all questions requested by the Area Office and document all verbal communications with these offices on standard office memo to be distributed to the Area Office, the District Construction Division, ATTN: CENWK-EC-C and the District PM. Any questions to the A-E from the contractor shall be referred to the Area Office. 20. Method of Payment. a. Design. The AE shall prepare and submit to the Kansas City District partial pay estimates in accordance with the Kansas City District Design Manual. b. Additional Conferences. Payment for furnishing the services of technically qualified representatives to attend additional conferences, when so requested in writing by the Contracting Officer, will be made at a rate per hour for the discipline involved plus travel expenses computed in accordance with Government Joint Travel Regulations in effect at the time travel is performed and actual cost of transportation. c. Services During Construction. Payment for services during construction will be made on a fee schedule basis as follows: i. Shop Drawings: Lump Sum. Payment for shop drawing services will be made in accordance with the same procedure as partial payments. ii. Engineering and Design During Construction: (1) Fee Schedule. Project Manager, clerk typist, architectural, mechanical, electrical and other engineering discipline employees as necessary. Man-hours for each discipline shall be adjusted so that total expenditures shall not exceed the cost ceiling to be set when the option is exercised including travel, reproduction and telephone. (2) Fee Adjustment. Should the service for engineering and design to be performed under this contract require fewer man-hours than those allowable under the cost ceiling above or should the Contracting Officer direct the A-E, in writing, to provide additional man-hours of services, the lump sum fee set forth will be adjusted to reflect such decrease or increase based on the rates specified. Payment for engineering and design will be made monthly based on the amount of work required. 21. AE Responsibility: a. This contract will remain in force until construction of the project has been completed. During this period, the AE will be responsible for the correction of any design errors or deficiencies and reimbursement of any reconstruction costs resulting there from pursuant to the provisions of AE Responsibility clause of the Contract Clauses of the contract. Should design changes as a result of revised criteria be required during this period, the AE may be required to perform the necessary redesign work. In those instances, the contract will be modified accordingly, including an adjustment in the contract amount. b. In the event discrepancies, omissions, or other errors in the drawings and specifications are discovered after the final submission, the AE shall revise the contract drawings or prepare sketches and the necessary data, including detailed cost estimate, and information to permit issuance of amendments or Modifications by the Government. This work shall be accomplished at no additional cost to the Government. c. Should the AE receive any direction or criteria that are not included in this contract that requires additional effort beyond the contract criteria the Contracting Officer shall be notified in writing describing the change(s) impact on the effort. d. AE approval of contractor shop drawings which are inconsistent with the AE's original design, and which prove to be inadequate for design intent, could be considered a design error or deficiency and handled accordingly. 22. Criteria: The design criteria referenced in this scope is intended to serve as a minimum standard for the AEin the preparation of a proposal for professional services which will satisfactorily meet design and construction standards for the proposed project. Technical manuals and other DoD criteria shall not be referenced in the specifications. The project requirements shall be abstracted and incorporated into the specifications. The enclosed data and criteria shall be used by the Architect-Engineer for preparation of the design: a. Section 01 10 00 Statement of Work and Appendices. c. Kansas City District Design Instruction Manual. d. All federal, state and local regulations governing lead, asbestos or other hazardous waste abatement.
