DEPARTMENT OF VETERANS AFFAIRSJustification and ApprovalForOther Than Full and Open Competition1.Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Health Care System (VAPSCHS), Seattle Division2.Description of Action: This is a request for other than full and open competition for the procurement of an InSpectraTM St02 Tissue Oxygenation Monitor Model 650 from Hutchinson Technology.Hutchinson Technology Inc 40 W. Highland Park Dr NE Hutchinson, MN 55350-9783 1-800-419-10073.Description of Supplies or Services: The InSpectraTm St02Tissue Oxygenation Monitor from Hutchinson Technology (Hutchinson, MN) is instrumental in completion of two of VA RR&D supported proposals (Socket Effect on Tissue Oxygenation during Amputee Gait (#4378) and Vacuum Suspension: Effect on Tissue Oxygenation, Activity and Fit (#3666)). These projects are carried about by staff at the VA RR&D Center for Limb Loss Prevention and Prosthetic Engineering at the VAPSCHS. The RR&D Center is focused on preventing limb loss, providing the best technology to support Veteran amputees, and insuring we are using the best tools in studying their outcomes. The Center's mission and this device supports the VA mission in total. The monitor is needed to complete the aforementioned projects which are neared or have reached the funding expiration dates. The required delivery date for the Tissue Oxygenation Monitor is 8/30/09.4.Statutory Authority: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements;( ) (2) Unusual and Compelling Urgency;( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services;( ) (4) International Agreement( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest5.Validity of Use of Statutory Authority: 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirement. The contract specialist verified through market research that Hutchinson Technology is the sole manufacturer/distributor of the Inspectra St02 Tissue Oxygen Monitor Model 650. I also received a statement from Hutchinson Technology verifying this. Please see attached memorandum.6.Actions to Promote Competition: In the future the contracting specialist will conduct market research for any new vendors that offer this product.7.Determination of Fair and Reasonable Price: The anticipated price for the Inspectra St02 Tissue Oxygen Monitor is $14,850.00. The contract specialist reviewed an Agilent Technology Monitor for $11,239.00 through their website that was a similar in function, but did meet many of the required salient characteristics stated by the requesting activity.8.Market Survey (FAR 10): In accordance with FAR Part 10, market research was performed. The contract specialist verified that Hutchinson Technology is the sole manufacturer and distributor.9.Other Considerations: Other competition options are not available as this monitor and its associated sensors are being modified to our unique specifications.10.Listing of Sources that expressed, in writing, an interest in the acquisition: None11.Statement of Actions to Overcome Barriers to Competition: Prior to making another sole source award to this vendor, the contracting specialist will research the market through the GSA E-Buy and Fed Biz Ops to ensure no other vendors can offer these items.12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under ray cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. 13 Aug 2009Name: Wesley EdmundsonDateTitle: Administrator OfficerFacility: VA Puget Sound Healthcare System Approvals in accordance with FAR 6.304a.
