- THIS IS A NOTICE FOR COMMERCIAL AWARD FOR A Labscan XE Sensor System or equivalent. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6, simplified acquisition procedures and the resultant purchase order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular 05-35. This solicitation is issued as a Request for Proposal (RFQ). This announcement constitutes the only solicitation and a written solicitation will not be issued. This synopsis, NAICS code 334516, is to notify contractors that the government intends to issue a Purchase Order in accordance with FAR Part 13.106 for the following specifications, under the simplified acquisition procedures. This solicitation is posted as a 100% small business set-aside to all qualified businesses and will be awarded as a Firm Fixed Price Purchase Order. Prospective offerors are responsible for downloading the solicitation and any amendments. It is the offeror's responsibility to monitor the FedBizOpps website for the release of any amendments to this solicitation. The Government reserves the right to award a contract without discussions if the Contracting Officer determines that the initial offer(s) is/are providing the Best Value and discussions are not necessary. The Office of Regulatory Affairs (ORA) has requested the purchase of the following pieces of Laboratory Equipment (brand name or equal - Hunterlabs): The product needs to follow generally the specifications and features of the Hunterlab Labscan XE spectrophotometer color management system. Quantity 1 - Part # LSXE/VS1 - Labscan XE Sensor, VSI Option. Product consists of XE sensor, standards box, user's manual and accessories, VSI option including four (4) port inserts Quantity 1 - Part # EZMQC-INS - Software and manual Quantity 1 - Part # CMR-2439 - Port plate and Power holder Quantity 1 - Part # D02-1009-200 - Sample clamp assembly Quantity 1 - Part # CMR-2713 - LXSE Capsule Port Plate Quantity 1 - Part # LSXE-SC-ASSY - Labscan XE Sample Cup Set Quantity 1 - ValuePakTSCV-BT - Hunterlab ValuePak for Benchtop Insturments (3 year contract) - package needs to include three years of technical support by phone, e-mail or fax, and three year warranty. The FDA's Forensic Chemistry Center (FCC) requires one (1) LabScan XE spectrophotometer color management system. The color management bench-top system requires that it be enabled to be used for method development and sample analysis for the Food Emergency Response Network (FERN) as well as for the forensic sample analysis of foods, drugs and dietary supplements. The product must have these key features: Measures reflected color using 0°/45° geometry Wavelength range 400 nm - 700 nm 10 nm optical resolution and reporting interval Large measurement diameter of 50 mm Excellent inter-instrument agreement Includes EasyMatch QC software Optional variable measurement areas from 50 mm to 5 mm Calibrated and controlled UV available Electronic record keeping that 21 CFR 11 compliant Delivery Locations FCC Laboratory 6751 Steger Drive, Cincinnati, OH, 45237 EVALUATION AND AWARD: The Government intends to evaluate proposals however; the Government reserves the right to award a contract without discussions if the Contracting Officer determines that the initial offer(s) is/are providing the Best Value and discussions are not necessary. The award will be made to the offeror whose proposal conforms to the terms and conditions of the solicitation under a Firm Fixed Price Purchase Order. Technical Requirements: The technical evaluation for this solicitation will be the equipments ability to meet the required specifications. Evaluation for Award: The award will be made to the party whose quote offers the best value to the government, technical and price. The Government may award this purchase order to other than the lowest priced technically acceptable quote. The Government will evaluate information based on the following evaluation criteria: 1) Technical Capability factor Meeting or Exceeding the Technical Requirements; 2) Price of product. Meeting the Technical Requirements is significantly more important than price. The FDA intends to make an award immediately after the response of this notice. The award will be made in accordance with FAR Part 13, Simplified Acquisition Procedures. CCR: Vendors must be registered in the Central Contractor Register (CCR) prior to the award of a contract. You may register by going to www.ccr.gov. You will need your Dun & Bradstreet number and banking information. QUESTIONS DEADLINE: All questions are to be submitted via email to: kevin.doss@fda.hhs.gov no later than September 2, 2009, 4:30 p.m. EST. No phone calls will be accepted. QUOTATIONS DUE: All quotations are due, via email to: kevin.doss@fda.hhs.gov, no later than September 6, 2009, 2:30 p.m. EST. PROVISIONS and CLAUSES: FAR 52.212-1 Instructions to Offerors - Commercial Items applies to this solicitation. (vi) The provision at FAR 52.212-2, Evaluation - Commercial Items is applicable to this solicitation. The specific evaluation criteria to be included in paragraph (a) of that provision are as follows: Technical and price. Technical are of greater importance when compared to price. Offerors must identify a point of contact for each by providing a name and telephone number. The government shall consider only the offeror whose offer conforms to this solicitation and will be most advantageous to the government, price and other factors considered. The government reserves the right to make an award without discussions. (vii) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items. (viii) The clause at FAR 52.212-4 applies to this acquisition. The following agenda have been attached to the clause: None. (ix) The clause at FAR 52.212-5 applies to this acquisition. The following additional FAR clauses cited in this clause are applicable: FAR 52.222-26, FAR 52.222-35, FAR 52.222-36, FAR 52.232-33. Clauses and provisions are incorporated by reference and apply to this acquisition. Clauses and provisions can be obtained at http://www.arnet.gov. All questions must be in writing and received by no later than June 25, 2008. No telephone request will be entertained. All responses to questions will be posted by way of an amendment to this combined synopsis/solicitation.
