The Office of Acquisition Management (A/LM/AQM) is conducting this acquisition for EMC Maintenance on behalf of Human Resources, Systems Development Division (HR/EX/SDD). The Department has a requirement for services needed for operation and maintenance of an enterprise Storage Area Network (SAN). This service will provide 24x7x365 hardware and software support for all components of HRs enterprise storage area network, including multiple DMX 800 storage arrays, redundant fiber channel switches, and numerous software products used in support of the EMC Mosaic model. This SAN supports all of HRs Integrated Personnel Management System (IPMS). The contractor shall provide mission critical support and service for all items listed on the request 24 hours a day 7 days a week for the duration of the period of performance in support of the Department of State and, in particular, the Bureaus Office of the Executive Director. These services include: Global field service network,7x24x365 Customer Support Centers, Software Assistance Center, Problem Recreation Lab for verifying products, performing benchmarks and replicating customer issues,The latest automatic, instantaneous problem-solving capabilities, which take full advantage of the remote support features built into EMC products, Proactive Service for anticipating potential hardware or code problems before they occur, Automatic escalation, Customer Education Centers in the US, Germany and Japan.41 USC 253(g) and FAR 13.501, Only One Responsible Source (Brand Name Only) is cited as the statutory authority for this justification.The maintenance required includes proprietary software updates and support, which are only available from the original manufacturer of the software product being supported (EMC), or from EMCs authorized resellers working directly with EMC. Their software has been developed and is solely maintained by EMC and/or their authorized resellers, and no other manufacturer or unauthorized third-party can provide bug fixes, updates, or upgrades to their software. The micro-code that supports the storage arrays is confidential and is not released to any other party. EMC has a set of proprietary diagnostic tools, which have been developed by EMC in order to properly maintain the equipment, and no other party has access to the required proprietary information to utilize them, except for EMC and EMC-authorized partners. For this reason, the EMC branded maintenance is the only product that meets the Departments requirements, and EMC and their authorized resellers are the only entities able to provide the EMC branded maintenance and software support items that are required by the Department. As this is a brand name only justification, no one contractors unique qualifications are used as a basis for this justification. Rather, the products identified by EMC brand name herein have been determined to be the only items that meet the Departments requirements. Although the EMC branded product is the only maintenance that meets the Departments needs, the items are available from EMC direct or through any of several EMC-authorized resellers. Period of Performance (POP) for all line items is 09-30-2009 through 09-29-2010 All Bids must be valid for 30 days from the closing date for this solicitation. No exceptions or qualifications. New equipment ONLY, NO remanufactured, refurbished, or gray-market products. All bid prices must include shipping FOB Destination CONUS (CONtinental U.S.). No partial shipments are permitted, unless otherwise specified by Contracting Officer at time of award. The selected Offeror must comply with the following term: FAR 52.225-5 Trade Agreements (Nov 2007). Please note: An article is considered a product of a country only if it is wholly a product of that country or if it has been substantially transformed in that country into a new and different article of commerce with a name, character, or use distinct from that of the original article(s). Note that any item that is a discreet article as it is sold in commerce, regardless of its ultimate function or use, cannot be considered substantially transformed based solely on its integration into IT or other systems.
