- June 29, 2009 JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION IN ACCORDANCE WITH FAR 13.106(b)(1) and 6.302-2(b)(1) 1. The South Texas Veterans Health Care System, Audie L. Murphy Division, intends to negotiate with VIASYS Health Care, Respiratory Care, 22745 Savi Ranch Parkway, Yorba Linda, CA 92887for a firm fixed price Service Agreement IAW Federal Acquisition Regulation competition 41 U.S.C. 253 (c)(3) and FAR 13.106-1(b)(1). 2. The requirement is for the purchase of one 3100B Oscillator, one BicBlender, W/2'3'H, Snsrmdcs, H/L and one Kitted Flexible Circuit for F&P 850 (Box of 4). 3. The Medical Service/Pulmonary Function has a Bona Fide need to procure the purchase of the 3100B Oscillator, one BicBlender, W/2'3'H, Snsrmdcs, H/L and one Kitted Flexible Circuit for F&P 850 (Box of 4). The estimated cost for the purchase is $31,801.30. 4. In accordance with 10. U.SC. 2304(c)(3), 41 U.S.C. 253(c)(3), Federal Acquisition Regulation (FAR) 13.106-1(b)(1) and 6.302-2(b). 5. This purchase is required to meet the requirements for a pandemic flu outbreak. This equipment is used in the treatment of patients afflicted with this disease. The system will be used on multiple VA patients based on physicians' orders due to certain types of ailments. This is a critical requirement as this item is used on the different floors and more importantly in the intensive care units (ICU's). This item will be used daily to expedite the continued use would keep the hospital patient system flow running at its normal frequency. The vendor can provide the supplies in a timely manner. 6. A Combined Synopsis and Solicitation will not be posted in the Federal Business Opportunity System, under FAR authority 6.302-2, due to the bone fide need to the care of VA patients. 7. It is anticipated that the negotiated cost to the Government for this procurement will be fair and reasonable. 8. Market research: there are no known contracts with the government, and the supply required is specific to the manufacturer of the item as they are familiar to the model itself. Based on my market research for the companies a 3100B Oscillator, one MicBlender, W/2'3'H, Snsrmdcs, H/L and one Kitted Flexible Circuit for F&P 850 (Box of 4). A sources sought was posted to identify vendors with this requirement. The sources sought was also used to identify the socio economic vendors for this requirement. Since the sources replied back that they could not. As a result of the sources sought it was determined that only one company could provide the required items, so in accordance with FAR Part 13.106(b) (1) procurement action was initiated. 9. There are no other vendors who could provide for the supply of the Oscillator. 10. Only one responsible source is intended under authorities of FAR 6.302-2(b)(1) & (2) and 13.106(b)(1). 11.
