Description
RECOVERY ACTION. FOR INFORMATIONAL PURPOSES ONLY. DUNS 195194779. The modification addresses the following work: This action is Revision No. 4 to Work Authorization RA-09-01 issued under Management and Operating Contract number DE-AC52-06NA25946 which is funded by American Recovery and Rehabilitation Act (ARRA) dollars. This modification authorizes the contractor to drill an offset due to down-hole field conditions on the first ARRA well. The ARRA objectives for the Environmental Management effort on the Nevada Test Site (NTS) includes assessing the degree of contamination of support facilities, soils, and groundwater resulting from the historic nuclear weapons testing program; and performing corrective actions required by federal and state regulations. The goal is to implement appropriate corrective actions and establish institutional controls to ensure the protection of human health and the environment. The action is other than fixed price because under Contract Clause Department of Energy Acquisition Regulation 970.5243.1, Changes (DEC 2000), of the contract authorizes the Contracting Officer to make changes within the general scope of the Management & Operating (M&O) contract. The work scope considered for acceleration as a result of the receipt of the ARRA funds is clearly within the scope of the contract. The prospects for performing the ARRA scope of work under a firm fixed-price (FFP) contract were evaluated prior issuance of the modification. The work contemplated is highly complex and many variables exist that do not lend themselves to the use of a fixed-price contract (FAR16.601(c)). NNSA/NSO has communicated to the M&O contractor that FFP subcontracts shall be utilized to the maximum extent possible in accomplishing the specific tasks executed with ARRA funds. NOTE: This action is awarded under Modification no. M068 and recognizes Work Authorization no. RA-09-01, Revision 4 issued under M&O Contract number DE-AC52-06NA25946. This action is funded by Recovery Act dollars.
