Description
The U.S. Department of State, Office of Acquisition Management intends to issue a Sole Source to FNH USA, LLC, McLean, VA for the acquisition of M249 Saw Para, quantity 6; M249 Saw Para Barrel, quantity 12; M240B, quantity 6; and M240B Barrell, quantity 12. FNH USA, LLC is the manufacturer of the M249 Saw Para and M240 weapons and do not offer these items for sale by their distributors, a customized weapon for the U.S. Department of Defense and other U.S. Government Agencies. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (1) It is recommend that the Department of State use other than full and open competition for the acquisition of M249, and M240B Machine Guns for the High Threat Protection. (2) It is required that the M249’s and M240B’s be purchased to issue to the agents an contractors assigned overseas at High Threat Posts. This will enable the agents to provide continued protection and security for assigned personnel. Additionally, continued safe travel and protected movement is required for high level U.S. Embassy and Consulate officials while traveling overseas, and for Ambassador level officials serving in international organizations working to restore and maintain economic and social stability. (3) The M249 Para is a lightweight 5.56mm machine gun with improvements to the weapons overall operation. The M249 Para has a barrel length of 16-1/4 inches. The buttstock is designed in plastic, and contains a hydraulic buffer. The barrel also incorporates a folding handle, fixed position gas port and an M16A2 flash suppressor. The M249 is also equipped with a heat shield, which clips easily onto the barrel and is easily removable. The overall length of the weapon is 41 inches, the total weight is 16.5 pounds, the barrel weight is 3.8 pounds, and the rate of fire is 750 rounds per minute. The M240B is equipped with an integrated optical feed cover and a handguard with heat shield to provide thermal protection to the operator. The M240B has the following characteristics: it’s gas operated, head-space and timing fixed, mean round between failure is 26,000, range: maximum 3725 meters, tracer burn out is 900 meters, cyclic rate of fire, which is operator adjustable, is: low rate = 750 rpm, high rate = 950 rpm, the muzzle velocity is 2800 ft/sec, and the slap ammunition compatibility has been verified. (4) The statutory authority permitting other than full and open competition is 41 USC 253 ©(1). The regulatory authority is FAR 6.302-1, Only one responsible source and no other supplies or service will satisfy the agency’s requirements. (5) Under the Diplomatic Security and Antiterrorism Act of 1986, the Bureau of Diplomatic Security has a broad range of responsibilities that include the protection of personnel and facilities, both domestic and abroad. Without the weapons and accessories requested, the Diplomatic Security Service will be unable to provide the proper level of security and protection. The M240B and M249’s are unique systems that our armorers are certified to repair, and that the agents and contractors have been trained to use. The U.S. Department of State does not utilize multiple weapons systems other than the ones agents are trained to utilize as this can create a liability issue. (6) FNH Manufacturing is the manufacturer and only supplier of these items. FNH has no distributors for these particular weapons systems. (7) The weapons requested are what the agents and contractors were trained to use during their initial training as Diplomatic Security Service Special Agent Training. The economic impact to the U.S. Government for using other items than what is requested, would be great and would involve the re-training of all agents in the field including purchasing all new weapons systems to issue to the various mission locations be it overseas or abroad. These items are needed by Nov 15, 2009 and due to the urgency of the request, it is imperative that this be treated as circumstances permitting other than full and open competition.
