- RECOVERY: This contract modification adds funding for waste management, environmental restoration, program support, and landlord activities at the Energy Technology Engineering Center site. The contract has been modified to extend services for facilities operation and site support services during the period required to complete the Environmental Impact Statement and Record of Decision for Area IV of the Santa Susana Field Laboratory. With the uncertainty of requirements associated with Recovery Act Funds, the possibility of having to chase contaminated soil, and possibilities of contaminants within the different facilities, it is not conceivable that a contractor would be willing to take on the risks under a fixed price contract. However, the contractor is encouraged where ever possible to award subcontracts on a fixed price basis. The Environmental Management Consolidated Business Center (EMCBC) did not consider whether to conduct a full and open competition for this effort because this effort was already approved under a Justification for Other than Full and Open Competition (JOFOC) which identified unique and special circumstances that warranted a sole source award to Boeing, as identified below. However, if a competition acquisition for this requirement was conducted the timing required for issuing a new contract (12-18 months), costs associated with demobilization/mobilization of a new contractor, and the costs to prepare safety bases documents, work plans, etc would impact the Governments ability to meet its commitments to the State of California and other stakeholders.
